The Standing Senate Committee on Legal and Constitutional Affairs, met this day, in Room 256-S, Centre Block at 10:32 a.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the committee present: The Honourable Senators Beaudoin, Carstairs, Doyle, Gigantès, Lewis, Lynch-Staunton, Milne, Nolin, and Pearson. (9)

Other senators present: The Honourable Senators Kinsella, Corbin and Haidasz (3).

In attendance: Laura Snowball, Research Officer, Research Branch of the Library of Parliament.

Also in attendance: The official reporters of the Senate.

WITNESSES:

Professor Hester Lessard, Faculty of Law, University of Victoria.

Professor Gerald Gall, Faculty of Law, University of Alberta.

Pursuant to the Order of Reference adopted by the Senate on Thursday, March 13, 1997, the committee continued its consideration Bill C-71, An Act to regulate the manufacture, sale, labelling and promotion of tobacco products, to make consequential amendments to another Act and to repeal certain Acts. (See Issue No. 50, Wednesday, March 19, 1997, for full text of Order of Reference. )

The Chair made an opening statement.

Professor Hester Lessard made a statement.

Professor Gerald Gall made a statement.

The witnesses answered questions.

Professor Gall agreed to send to the committee his analysis of the search and seizure provisions of Bill C-71.

The Chair announced the schedule of hearings on Bill C-71 agreed to by the Steering committee.

Senator Haidasz asked for leave to table draft amendments with the Committee.

The Chair noted that the committee distributes documents only in both official languages.

Senator Lewis moved -- THAT when the draft amendments are available in both official languages, they be tabled with the committee.

The question being put on the motion, it was agreed.

At 12:22 p.m., the committee adjourned to the call of the Chair.
