The Standing Senate Committee on Legal and Constitutional Affairs, met this day, in Room 505, Victoria Building at 12:00 p.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the committee present: The Honourable Senators Beaudoin, Carstairs, Gigantès, Jessiman, Lewis, Losier-Cool, Milne, Moore, Nolin, and Pearson (10).

Other senator present: The Honourable Senator Kenny (1).

In attendance: Laura Snowball, Research Officer, Research Branch of the Library of Parliament.

Also in attendance: The official reporters of the Senate.

WITNESSES:

Professor Wayne MacKay, Nova Scotia Human Rights Commission (on leave from Dalhousie University);

Professor Richard Pollay, Faculty of Commerce, University of British Columbia.

Dr. Allan Best, National Cancer Institute of Canada.

From the National Association of Tobacco and Confectionery Distributors:

Mr. Luc Dumulong, Executive Vice-President;

Mr. Mark Tobenstein, Chairman and owner of Distribution Regitan Ltd.;

Pursuant to the Order of Reference adopted by the Senate on Thursday, March 13, 1997, the committee continued its consideration Bill C-71, An Act to regulate the manufacture, sale, labelling and promotion of tobacco products, to make consequential amendments to another Act and to repeal certain Acts. (See Issue No. 50, Wednesday, March 19, 1997, for full text of Order of Reference. )

The Chair made an opening statement.

Professor Wayne MacKay made a statement and answered questions.

At 12:34 p.m., the committee suspended.

At 12:38 p.m., the committee resumed.

Professor Richard Pollay made a statement and showed a series of slides.

Dr. Allan Best made a statement.

The witnesses answered questions.

Senator Nolin tabled with the Committee a transcript of part of the cross-examination of Professor Pollay at the Supreme Court (Exhibit No. 5900 L1-C-71-55 "6").

Mr. Luc Dumulong made a statement and, together with Mr. Tobenstein and Mr. Crouch, answered questions.

Mr. Joseph Chung made a statement and answered questions.

Dr. Brian Smith made a statement and answered questions.

Dr. Smith agreed to provide to the committee a list of peer-reviewed documents supporting his opinion.

At 4:47 p.m., the committee adjourned to the call of the Chair.
