The Standing Senate Committee on Social Affairs, Science and Technology met at 8:35 a.m. this day in Room 356-S, Centre Block, the Chair, the Honourable Senator Mabel M. DeWare, presiding.
Members of the committee present: The Honourable Senators Bonnell, Bosa, Cohen, Cools, DeWare, Forest, Jessiman, Losier-Cool, Maheu, Pearson and Phillips. (11)

Pursuant to the Order of Reference adopted by the Senate on Thursday, November 28, 1996, the committee resumed consideration of Bill C-41, An Act to amend the Divorce Act, the Family Orders and Agreements Enforcement Assistance Act, the Garnishment, Attachment and Pension Diversion Act and the Canada Shipping Act (for complete text of Order of Reference see proceedings of the Committee dated December 4, 1996, Issue No. 15).
Michael J. Day made an opening statement and answered questions.
At 9:38 a.m., the meeting was suspended.
At 9:42 a.m., the meeting resumed.
Paul Carrier made an opening statement and answered questions.
At 10:35 a.m., the meeting was suspended.
At 10:40 a.m., the meeting resumed.
Professor Ross Finnie made an opening statement and answered questions.
At 11:45 a.m., Sean Cummings made an opening statement and answered questions.
At 12:35 p.m., the committee adjourned to the call of the Chair.

The Honourable Senator Phillips moved, That the membership of the Subcommittee on Veterans Affairs be increased from five to seven members, and that the Honourable Senator Jessiman be appointed from the Opposition.
The question being put on the motion, it was agreed.
At 1:40 p.m., Judy Poulin made an opening statement and, together with Wendy Byrne and Barbara Thompson, answered questions.
At 1:45 p.m., the Honourable Senator Losier-Cool assumed the Chair.
At 1:55 p.m., the Honourable Senator DeWare resumed as Chair.
At 2:10 p.m., the meeting was suspended.
At 2:15 p.m., the meeting resumed.
George Thompson made an opening statement and, together with Murielle Brazeau and Carolina Giliberti, answered questions.
At 3:30 p.m., the meeting was suspended.
At 3:55 p.m., the meeting resumed.
The Honourable Senator Bosa moved, That the committee adjourn until Monday, February 3, 1997 at 2:00 p.m. to give the Committee an opportunity to consider the evidence before them.
The question being put on the motion, it was, by a show of hands, defeated: yeas: 6; nays: 6.
The Chair then proceeded to clause-by-clause consideration of the Bill.
The question being put to postpone the title, it was agreed.
The question being put to carry Clause 1, the Honourable Senator Jessiman moved,
That C-41, in Clause 1, be amended by replacing lines 9 and 10 on page 2 with the following:
"of illness, disability or other cause, to with--"
The Honourable Senator Bosa moved as a subamendment to the proposed amendment,
That "or other cause" be retained.
After discussion, the question being put on the motion in subamendment, it was, by a show of hands, defeated: yeas: 6; nays: 6.
The question being put on the motion to amend Clause 1, it was, by a show of hands, defeated: yeas: 6; nays: 6.
The question being put to carry Clause 1 unamended, it was, by a show of hands, defeated: yeas: 6; nays: 6.
The Chair proceeded to consideration of Clause 2.
The Honourable Senator Bosa moved, That the Committee proceed to now consider the remaining clauses of the Bill.
The Chair ruled that the motion was out of order.
The Honourable Senator Bosa appealed the Chair's ruling.
At 4:50 p.m., the meeting was suspended.
At 5:15 p.m., the meeting resumed.
The question "Shall the decision of the Chair be sustained?" being put, it was, by a show of hands, defeated: yeas: 6; nays: 6.
At 5:30 p.m., the committee adjourned to the call of the Chair.
