The Standing Senate Committee on Banking, Trade and Commerce met this day at 3:45 p.m. in Room 505, Victoria Building, the Chair, the Honourable E. Leo Kolber, presiding.

Members of the committee present: The Honourable Senators DeWare, Furey, Hervieux-Payette, P.C., Kelleher, P.C., Kolber, Kroft, Oliver, Poulin, Rossiter, Tkachuk and Wiebe (11).

In attendance: From the Parliamentary Research Branch, Library of Parliament: Alexandre Laurin, Research Officer.

Also present: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, June 14, 2000, the committee proceeded to study Bill C-25, An Act to amend the Income Tax Act, the Excise Tax Act and the Budget Implementation Act, 1999.

Mr. Colby made an opening statement and then, along with other witnesses, answered questions.

Mr. Ashton made an opening statement and then, along with other witnesses, answered questions.

Mr. MacKnight made an opening statement and then answered questions.

Mr. Cullen made an opening statement and then, along with other witnesses, answered questions.

It was moved by the Honourable Senator Poulin, -- That the committee begin clause by clause study of Bill C-25.

The question being put on the motion, it was agreed.

It was agreed, -- That the title be postponed.

It was agreed, -- That clauses 2 to 69 carry.

The question being put on clauses 70 to 72, the committee divided in the following manner:

YEAS: 5

NAYS: 5

Therefore, the vote being equal, the clauses were negatived.

At 7:00 p.m., the committee adjourned to the call of the Chair.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, June 14, 2000, the committee proceeded to study Bill C-25, An Act to amend the Income Tax Act, the Excise Tax Act and the Budget Implementation Act, 1999.

The Chair asked for leave to revert to consideration of clauses 70 to 72.

With leave, the committee reverted to consideration of clauses 70 to 72.

It was agreed, -- That clauses 70 to 72 carry.

It was agreed, -- That clause 73 carry.

It was agreed, -- That the title carry.

It was moved by the Honourable Senator Poulin, -- That Bill C-25 be reported without amendment to the Senate.

The question being put on the motion, it was agreed on division.

At 11:05 a.m., pursuant to the Order of Reference adopted by the Senate on Thursday, April 6, 2000, the committee proceeded to study Bill S-19, An Act to amend the Canada Business Corporations Act and the Canada Cooperatives Act and to amend other Acts in consequence. (See Issue No. 10, April 13, 2000, for the full text of the Order of Reference.)

Mr. McIninch made an opening statement and then, along with Dr. Anisman, answered questions.

It was agreed, -- That a letter from the Canadian Bar Association be printed as an appendix to this day's Minutes of Proceedings (see Appendix 5900 B1/S-19, 17 "1").

At 12:00 p.m., the committee adjourned to the call of the Chair.
