The Standing Senate Committee on Legal and Constitutional Affairs met this day at 3:53 p.m. in room 257, East Block, the Chair, the Honourable Lorna Milne, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Beaudoin, Buchanan, P.C., Cools, Fraser, Joyal, P.C., Milne, Moore, Pearson, and Poy (10).

In attendance: From the Research Branch of the Library of Parliament: Nancy Holmes and Marilyn Pilon, Research Officers.

Also in attendance: The official reporters of the Senate.

WITNESSES:

From the Canadian Police Association:

David Griffin, Executive Officer.

From the Fédération des policiers et policières municipaux du Québec:

Yves Prud'homme, President;

Christine Beaulieu, Coordinator of Communications.

From the Department of Justice:

Hal Pruden, Legal Counsel, Criminal Law Policy Section;

Donald K. Piragoff, General Counsel, Criminal Law Policy Section.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, February 22, 2000, the committee continued its examination of Bill C-202, An Act to amend the Criminal Code (flight). (See proceedings of the committee, Issue No. 9, dated February 23, 2000, for full text of Order of Reference.)

Messrs Griffin and Prud'homme made presentations and answered questions.

Messrs Pruden and Piragoff answered questions.

At 5:46 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10:56 a.m., in room 257, East Block, the Chair, the Honourable Lorna Milne, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Beaudoin, Buchanan, P.C., Cools, Fraser, Joyal, P.C., Milne, Moore, Nolin, Pearson, and Poy (11).

In attendance: From the Research Branch of the Library of Parliament: Nancy Holmes and Marilyn Pilon, Research Officers.

Also in attendance: The official reporters of the Senate.

At 10:57 a.m., the committee proceeded in camera to consider future business.

It was agreed that Senate staff be permitted to remain in the room during the in camera proceedings.

It was agreed that committee staff develop terms of reference for a possible future study on sentencing in Canada.

At 11:15 a.m., the committee resumed in public.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, February 22, 2000, the committee continued its examination of Bill C-202, An Act to amend the Criminal Code (flight). (See proceedings of the committee, Issue No. 9, dated February 23, 2000, for full text of Order of Reference.)

It was moved by the Honourable Senataor Beaudoin -- That the committee do now proceed to clause-by-clause consideration of Bill C-202.

The question being put on the motion, it was adopted.

It was moved by the Honourable Senator Moore -- That the committee approve all clauses of Bill C-202, An Act to amend the Criminal Code (flight), and that the Chair be authorized to report the bill without amendment, but noting the parchment error discussed at the meeting of February 23, 2000.

After debate, the question being put on the motion, it was adopted on division.

The committee proceeded to consider the following draft budget:

Professional and Other Services $ 15,600
Transportation and Communications 11,050
Other Expenditures 2,500
TOTAL $ 29,150

After debate, it was agreed that the draft budget be approved for submission to the Standing Committee on Internal Economy, Budgets and Administration.

At 11:37 a.m., the committee adjourned to the call of the Chair.
