The Standing Senate Committee on Legal and Constitutional Affairs met this day at 3:43 p.m. in Room 257, East Block, the Chair, the Honourable Lorna Milne, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Christensen, Joyal, P.C., Milne, Moore, and Pearson (6).

Other Senators present: The Honourable Senator LeBreton (1).

In attendance: From the Research Branch of the Library of Parliament: Nancy Holmes, Research Officer.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, June 22, 2000, the committee began its examination of Bill C-18, An Act to amend the Criminal Code (impaired driving causing death and other matters).

WITNESSES:

From the Department of Justice:

Catherine Kane, Acting Senior General Counsel, Criminal Law Policy Section;

Hal Pruden, Legal Counsel, Criminal Law Policy Section.

From the Canadian Police Association:

David Griffin, Executive Officer.

From Mothers Against Drunk Driving Canada (MADD):

Carolyn Swinson, National President.

Ms. Kane and Mr. Pruden made a presentation and answered questions.

Mr. Griffin made a presentation and answered questions.

Ms. Swinson made a presentation and answered questions.

Ms. Kane and Mr. Pruden returned to the table and answered questions.

At 5:02 p.m., the committee suspended.

At 5:32 p.m., the committee resumed.

The Honourable Senator Christensen moved -- That the committee do now proceed to clause-by-clause consideration of Bill C-18, An Act to amend the Criminal Code (impaired driving causing death and other matters).

The question being put on the motion, it was adopted.

It was agreed -- That the title stand postponed.

It was agreed -- That clause 1 carry.

It was agreed -- That clause 2 carry.

It was agreed -- That clause 3 carry.

It was agreed -- That clause 4 carry.

It was agreed -- That clause 5 carry.

It was agreed -- That the title carry.

It was agreed -- That the bill carry.

It was agreed -- That the Chair report the Bill to the Senate without amendment.

At 5:35 p.m., the committee adjourned to the call of the Chair.
