The Standing Senate Committee on Energy, the Environment, and Natural Resources met at 9:01 a.m. this day, inroom 256 Centre Block, the Chair, the Honourable Nicholas W. Taylor, presiding.

Members of the committee present: The Honourable Senators Adams, Banks, Christensen, Cochrane, Finnerty, Kenny and Taylor (7).

Other senators present: The Honourable Senator Robichaud, P.C. (1).

In attendance: From the Research Branch of the Library of Parliament: Lynne Myers, Research Officer and Mary Hurley.

Pursuant to the Order of Reference adopted by the Senate on November 27, 2001, the committee proceeded to studyBill C-33 (See Issue No.19, Thursday, November 27, 2001 for full text of the Order of Reference).

APPEARING:

The Honourable Robert D. Nault, P.C., M.P., Minister of Indian Affairs and Northern Development.

The Honourable Paul Okalik, Premier, Government of Nuna vut.

WITNESSES:

From the Mining Association of Canada:

Mr. Pierre Gratton, Vice President, Public Affairs andCommunications;

Mr. Michael Hardin, General Counsel and Corporate Secretary;

Mr. Mike Vaydik, General Manager, Northwest Territories and Nunavut Chamber of Mines.

From the Government of Nunavut:

Mr. Lois M. Leslie, Senior Legal Advisor.

From the Department of Indian Affairs and NorthernDevelopment:

Mr. Daniel Ricard, Senior General Counsel;

Mr. Will Dunlop, Director, Resource Policy and Transfers Directorate.

The witnesses made a presentation and answered questions.

The Minister of Indian Affairs and Northern Development submitted a brief.

It was moved by the Honourable Senator Kenny - That Premier Okalik be permitted to direct questions to the Minister concerning non-derogation clause.

After debate, the question being put on the motion, it was adopted.

At 10:40, the ommittee suspended.

At 10:45, the committee resumed.

The Minister tabled letters that he wrote, which was filed as exhibit no. 5900-1.37/E1-C-33, 22 "1" and documents regarding the Northwest Territories Water Board, which was filed as exhibit no. 5900-1.37/E1-C-33-22 "2".m

At 12:00 p.m., It was agreed - That the committee adjourn to the call of the Chair.
