The Standing Senate Committee on Transport and Communications met this day at 9:31 a.m., in room 256, Centre Block, the Chair, the Honourable Lise Bacon, presiding.

Members of the committee present: The Honourable Senators Adams, Bacon, Biron, Callbeck, Gill, LaPierre, Oliver and Spivak (8).

In attendance: Martin Brennan, Special Advisor to the Committee and Joseph Dion, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on November 6, 2001, the committee proceeded to study Bill C-34. (See Issue No. 17, Tuesday, November 20, 2001 and Wednesday, November 21, 2001 for full text of the Order of Reference.)

WITNESSES:

From the Canadian Maritime Law Association:

William Moreira, Vice-President, Atlantic;

Donald Morrison, President, Canadian Shipowners Association;

Shane Foreman, Manager, Policy and Research, Canadian Shipowners Association.

From the Railway Association of Canada:

Chris Jones, Director, Federal-Provincial Government Liaison;

Gérald Gauthier, Director, Industry Liaison.

The witnesses made a presentation and answered questions.

The Canadian Maritime Law Association, the Canadian Shipowners Association and the Railway Association of Canada submitted a brief.

It was agreed - That the Committee proceeded to the clause-by-clause consideration of Bill C-34.

It was agreed - That the title stand postponed.

It was agreed - That clause 1 stand postponed.

It was agreed - That clauses 2 to 22 carry.

It was agreed - That clauses 23 to 32 carry.

It was agreed - That clauses 33 to 45 carry.

It was agreed - That clauses 46 to 63 carry.

It was agreed - That clauses 64 to 70 carry.

It was agreed - That clauses 71 to 73 carry.

It was agreed - That clause 1 carry.

It was agreed - That the Title carry.

It was agreed - That the Bill be adopted without amendment.

At 10:47, the committee proceeded in camera to discuss possible observations.

It was agreed - That the Chair report the Bill, as adopted, with observations, to the Senate.

At 11:01 a.m., It was agreed - That the committee adjourn to the call of the Chair.
