The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:22 p.m., in room 257, East Block, the Chair, the Honourable George J. Furey, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Cools, Furey, Joyal, P.C., Mercer, Rivest, Smith,P.C. and Stratton (8).

In attendance: From the Library of Parliament, Margaret Young and Megan Furi.

Also in attendance: The official reporters of the Senate.

The Honourable Senator Joyal, P.C. moved, that the Honourable Senator Andreychuk be Deputy Chair of this committee.

The question being put on the motion, it was adopted.

At 4:25 p.m., the committee proceeded to discuss BillC-17

Pursuant to the Order of Reference adopted by the Senate on Tuesday, March9, 2004, the committee continued its consideration of BillC-17, to amend certain Acts. (For complete text of Order of Reference see proceedings of the committee, Issue No. 5.)

It was agreed, that the committee move to clause-by-clause consideration of BillC-17.

It was agreed, that the title stand postponed.

It was agreed, that the short title stand postponed.

It was agreed, that clauses 1 to 10 carry.

It was agreed, that clauses 11 to 20 carry.

It was agreed, that clauses 21 to 32 carry.

It was agreed, that the short title carry.

It was agreed, that the title carry.

It was agreed, that the Chair report the bill, without amendment at the next sitting of the Senate.

At 4:30 p.m., the committee proceeded to discuss BillC-3

Pursuant to the Order of Reference adopted by the Senate on Thursday, April22, 2004, the committee began its consideration of BillC-3, to amend the Canada Elections Act and the IncomeTax Act.

APPEARING:

The Honourable Jacques Saada, P.C., M.P., Leader of the Government in the House of Commons and Minister responsible for Democratic Reform.

WITNESSES:

Stéphane Perrault, Privy Council Officer, Senior Counsel, Legislation and House Planning;

Stephen Zaluski, Privy Council Officer, Senior Counsel, Legislation and House Planning.

The Honourable Jacques Saada, P.C., M.P., made a statement and together, witnesses answered questions.

The Honourable Jacques Saada, P.C., M.P. submitted a brief to the committee.

At 5:36 p.m., the committee adjourned to the call of the Chair.

Members of the committee present: The Honourable Senators Andreychuk, Cools, Furey, Joyal, P.C., Lynch- Staunton, Mercer,Nolin, Pearson, Rivest, Smith, P.C. and Stratton (11).

Pursuant to the Order of Reference adopted by the Senate on Thursday, April22, 2004, the committee continued its consideration of BillC-3, to amend the Canada Elections Act and the Income Tax Act.

WITNESSES:

From Elections Canada:

Jean-Pierre Kingsley, Chief Electoral Officer;

Diane R. Davidson, Deputy Chief Electoral Officer and Chief Legal Counsel;

James Sprague, Senior Practitioner and General Counsel.

Jean-Pierre Kingsley made a statement and answered questions.

Elections Canada submitted a brief to the committee.

At 12:13 p.m., the committee proceeded to discuss BillC-20.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, March9, 2004, the committee continued its consideration of BillC-20, to change the names of certain electoral districts. (For complete text of Order of Reference see proceedings of the committee, Issue No. 5.).

It was agreed, that the document entitled "Sixteenth Report of the Standing Committee on Procedure and House Affairs (37-3)'' presented by Senator Joyal, P.C. be printed as an appendix to this day's Minutes of Proceedings.

It was agreed, that the committee move to clause-by-clause consideration of BillC-20.

It was agreed, that the title stand postponed.

It was agreed, that clauses 1 to 10 carry.

It was agreed, that clauses 21 to 30 carry.

It was agreed, that clauses 31 to 39 carry.

It was agreed, that the title carry.

It was agreed, that clauses 11 to 20 carry.

It was agreed, that the Chair report the bill, without amendment, but with some amendments to the Senate.

At 12:22 p.m., the committee adjourned to the call of the Chair.
