The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10:32 a.m., in room 257, East Block, the chair, the Honourable Bob Runciman, presiding.

Members of the committee present: The Honourable Senators Baker, P.C., Batters, Boisvenu, Dagenais, Fraser, Jaffer, Joyal, P.C., McIntyre, Plett, Runciman and White (11).

In attendance: Julian Walker and Maxime Charron-Tousignant, Analysts, Parliament Information and Research Services, Library of Parliament.

Also present: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Thursday, January 28, 2016, the committee continued its examination of the study on matters pertaining to delays in Canada's criminal justice system. (For complete text of the order of reference, see proceedings of the committee, Issue No. 1.)

WITNESSES:

Canadian Bar Association:

Ian M. Carter, Treasurer, Criminal Justice Section;

Tony Paisana, Executive Member, Criminal Justice Section (by video conference);

Gaylene Schellenberg, Lawyer, Legislation and Law Reform.

Criminal Lawyers' Association:

Leo Russomanno, Member and Criminal Defence Counsel;

Dominic Lamb, Member.

Canadian Council of Criminal Defence Lawyers:

William Trudell, Chair;

Greg DelBigio, Member.

The chair made a statement.

It was agreed that the document entitled R v. Bordo, 2016 QCCS 477, presented by the Honourable Senator Joyal, P.C., be filed as an exhibit (Exhibit 362109-41.2/LCJC-SS1, 2 "1'').

Ms. Schellenberg, Mr. Carter and Mr. Paisana made statements and answered questions.

At 11:24 a.m., the committee suspended.

At 11:29 a.m., the committee resumed.

Mr. Russomanno, Mr. Lamb, Mr. Trudell and Mr. DelBigio made statements and answered questions.

At 12:28 p.m., the committee adjourned to the call of the chair.
