The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 257, East Block, at 10:55 a.m., the Chair, the Honourable Lorna Milne, presiding.

Members of the committee present: The Honourable Senators Balfour, Beaudoin, Fraser, Joyal, P.C., Milne, Moore and Pépin (7).

Other senator present: The Honourable Senator Grafstein (1).

In attendance: David Goetz, Research Officer, Research Branch, Library of Parliament.

Pursuant to the Order of Reference adopted by the Senate on Thursday, June 18, 1998, the committee continued its consideration of Bill C-25, An Act to amend the National Defence Act and to make consequential amendments to other Acts. ( See Issue No. 33, Thursday, October 1, 1998, for full text of Order of Reference).

WITNESSES:

From the Special Advisory Group on Military Justice and Military Police Investigation Services (March 1997):

Lieutenant-General (retired) Charles H. Belzile, C.M.M., C.D., Member;

Lise Maisonneuve, Special Legal Advisor

From the Department of National Defence:

Colonel Allan Fenske, Deputy Judge Advocate General, Advisory and Legislation; Canadian Forces, National Defence Act Amendment Team.

The Chairman made a statement regarding the memorial service for former Chief Justice Brian Dickson.

Mr. Belzile made a statement.

The committee agreed to invite Col Fenske to the table.

Mr. Belzile, Col Fenske and Lise Maisonneuve answered questions.

The committee agreed to call the Department of National Defence next Wednesday, November 4, 1998, on Bill C-25.

At 12:55 p.m., the committee adjourned to the call of the Chair.
