The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 505, Victoria Building, at 9:04 a.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the Committee present: The Honourable Senators Beaudoin, Bryden, Carstairs, Doyle, Gigantès, Jessiman, Lewis, MacDonald (Halifax), Milne, Nolin, Pearson, Stanbury and Stewart (13).

In attendance: Mollie Dunsmuir, Research Officer, Research Branch of the Library of Parliament.

Also in attendance: The official reporters of the Senate.

John Desmarais, Director General, Special Projects and Operations Coordination;

Mike Baker, Director, Corporate Issues, Corporate Relations, Policy and Coordination Group.

Pursuant to the Order of Reference adopted by the Senate on Thursday, May 30, 1996, the committee commenced its consideration of Bill C-28, An Act respecting certain agreements concerning the redevelopment and operation of Terminals 1 and 2 at Lester B. Pearson International Airport.

The Chair made an opening statement.

It was moved by the Honourable Senator Nolin -- THAT any consideration or votes on any motions dealing with the disposition in Committee of Bill C-28 be held no earlier than at the completion of hearing of all witnesses.

It was agreed, -- THAT the Steering Committee meeting scheduled for today be postponed until following the appearance of the Minister of Justice on Thursday, June 6, 1996.

It was moved by the Honourable Senator MacDonald, -- THAT the committee indicate to the Minister of Transport that his testimony would be very helpful to the committee on Bill C-28 and, -- THAT the Minister should appear before the committee.

After debate, it was moved by the Honourable Senator Bryden, -- THAT the motion by Senator MacDonald be amended to read: THAT a written invitation to appear be sent today to the Minister of Transport by the Chair, on behalf of the committee.

The question being put on the motion, it was agreed.

It was agreed, -- THAT Senator Bryden table with the committee proposals for amendment to Bill C-28.

Senator Bryden noted that the tabled amendments do not include any amendments to clauses 9 and 10 of Bill C-28, despite the possibility of removing these clauses from the Bill. Senator Bryden explained that this absence is because the correct procedure would be to vote against the clauses standing part of the Bill, rather than moving amendments to delete the clauses (Beauchesne §698 (6)).

Mr. Desmarais made a statement and, together with Mike Baker, answered questions.

At 11:02 a.m., the committee adjourned to the call of the Chair.
