The Standing Senate Committee on National Finance met at 11:00 a.m. this day, in Room 505, Victoria Building, the Chairman, the Honourable Terrance R. Stratton, presiding.

Members of the committee present: The Honourable Senators Bolduc, Bryden, Cools, Forest, Joyal, P.C., Kinsella, Lavoie-Roux, Mercier, Moore, Rivest, Sparrow and Stratton (12).

Other senators present: The Honourable Senators Beaudoin and Simard (2).

In attendance: Mr. Guy Beaumier, Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Monday, June 8, 1998, the committee continued its examination of Bill C-36.

The Honourable Paul Martin made a statement and, with Ms Elliott, answered questions.

It was agreed, -- That letters from Coopers & Lybrand and from Ernst & Young on the Canada Millennium Scholarship Foundation, be tabled with the committee.

Mr. Cunningham from the Canadian Cancer Society made a statement and answered questions.

Ms McCaleb, Mr. Russ and Mr. Obonsawin made a statement and, with Mr. Meehan, answered questions.

Mr. Grandisson from the Department of Finance and Mr. Carrière from the Department of Justice answered questions.

Mr. Meehan made a statement in response to the presentation by Mr. Grandisson and Mr. Carrière.

Mr. Larose made a statement and, with the assistance of the other witnesses from the Confédération des syndicats nationaux, answered questions.

At 3:15 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on National Finance met at 4:35 p.m. this day, in Room 505, Victoria Building, the Chairman, the Honourable Terrance R. Stratton, presiding.

Pursuant to the Order of Reference adopted by the Senate on Monday, June 8, 1998, the committee continued its examination of Bill C-36.

It was agreed -- That the committee complete clause-by-clause consideration of Bill C-36.

It was agreed -- That the title be stood.

It was agreed -- That clause 1, the short title be stood.

It was moved by the Honourable Senator Bolduc -- That Bill C-36 be amended, in clause 10(a), on page 7, by replacing lines 38 and 39 with the following:

"Canada, the needs of the Canadian economy and the management of investments; and"

It was moved by the Honourable Senator Bolduc -- That Bill C-36 be amended, in clause 29(1), on page 14, be replacing lines 40 and 41 with the following:

"do so and if it requested by a particular provincial minister, the Foundation shall enter into an agreement with the provincial minister respect-".

It was moved by the Honourable Senator Lavoie-Roux -- That Bill C-36 be amended, in clause 8(2)(b), on page 5, by replacing lines 6 and 7 with the following:

"(b) five persons, two of whom shall be students attending an eligible institution,"

It was moved by the Honourable Senator Lavoie-Roux -- That Bill C-36 be amended, in clause 27, on page 14, by replacing lines 20 to 22 with the following:

It was moved by the Honourable Senator Bolduc -- That Bill C-36 be amended, on page 19, by adding the following immediately after line 23:

"42.1 The Board shall appoint an investment committee, which shall

(a) perform the duties delegated to it by the Board;

(b) approve the engagement of investment managers empowered with discretionary authority to invest the assets of the Foundation;

(c) meet with the officers and employees of the Foundation to discuss the effectiveness of the Board's investment policies and the achievement of the Foundation's objects;

(d) require management to implement and maintain appropriate procedures to

(i) monitor the application of the Board's investment policies, standards and procedures, and

(ii) ensure that the Foundation's agents comply with this Act and the Board's investment policies, standards and procedures; and

(e) review, evaluate and approve management's procedures referred to in paragraph (d).".

"133. Sections 2 to 46 and 127 to 132 come into force"
