(12) [English] The Standing Senate Committee on Legal and Constitutional Affairs met at 3:35 p.m., this day, in Room 257, East Block, the Honourable Senator Milne, Chair, presiding. Members of the committee present: The Honourable Senators Atkins, Banks, Cools, Joyal, P.C., Milne, Moore, Nolin and Pearson (8). In attendance: From the Library of Parliament: Nancy Holmes. Also in attendance: The official reporters of the Senate. Pursuant to the Order of Reference adopted by the Senate on Wednesday, April 9, 2001, the committee proceeded to study Bill C-12, An Act to amend the Judges Act and to amend another Act in consequence. (See Issue No. 6, Thursday, May 10, 2001 for full text of the Order of Reference.) WITNESSES: Panel: Denis Guay, Acting Commissioner for Federal Judicial Affairs; Wayne Osborne, Director, Financial Services, Federal Judicial Affairs; Richard Drouin, Chair, 1999 Judicial Compensation and Benefits Commission; Debi Lapierre, Executive Director, 1999 Judicial Compensation and Benefits Commission; André Sauvé, Actuary, 1999 Judicial Compensation and Benefits Commission. From the Office of the Superintendent of Financial Institutions: Jean-Claude Ménard, Chief Actuary; Lou Cornelis, Principal Actuary, Valuation Unit B; Steve McCleave, Senior Actuarial Assistant, Valuation Unit B. Richard Drouin and Denis Guay made opening statements and, together with Wayne Osborne and André Sauvé, answered questions. At 5:15 p.m., the committee suspended. At 5:25 p.m., the committee resumed. Jean-Claude Ménard made an opening statement and, together with Steve McCleave and Lou Cornelis, answered questions. The Honourable Senator Serge Joyal read a quotation from the brief submitted by the Canadian Bar Association into the record. At 6:22 p.m., the committee went in camera, to discuss a matter of future business. It was agreed that the in camera debate be recorded and the transcript be made available to the committee members who were not present. At 6:27 p.m., the committee adjourned to the call of the Chair. Members of the committee present: The Honourable Senators Andreychuk, Banks, Beaudoin, Cools, De Bané, P.C., Finestone, P.C., Joyal, P.C., Milne, Moore and Nolin (10). In attendance: From the Library of Parliament: Nancy Holmes. Also in attendance: The official reporters of the Senate. Pursuant to the Order of Reference adopted by the Senate on Wednesday, April 9, 2001, the committee proceeded to study Bill C-12, to amend the Judges Act and to amend another Act in consequence. (See Issue No. 6, Thursday, May 10, 2001 for full text of the Order of Reference.) WITNESS: From the Department of Justice: Judith Bellis, Senior Counsel, Judicial Affairs Unit. It was agreed - That the committee proceed to clause-by-clause consideration of Bill C-12. It was agreed - That the title stand postponed. It was agreed - That clauses 1 to 16 carry. After debate, it was agreed - That clause 17 carry. The committee discussed clause 18. Ms Bellis answered questions. It was agreed - That clause 17 carry. It was agreed - That clause 18 carry, on the following division: YEAS: Milne, Andreychuk, Beaudoin, De Bané, Finestone, Moore, Nolin - 7 NAYS: Banks, Cools - 2 ABSTENTIONS: Joyal - 1 It was agreed - That clauses 19 to 27 carry. It was agreed - That the Title carry. It was agreed - That this Bill be adopted without amendment. It was agreed - That the Chair report this Bill without amendment, on division. At 12:15 p.m., the committee went in camera to discuss a matter of future business.
