The Standing Senate Committee on Banking, Trade and Commerce met this day, at 4:07 p.m. in room 2, Victoria Building, the Deputy Chair, the Honourable W. David Angus, presiding.

Members of the committee present: The Honourable Senators Angus, Cordy, Hervieux-Payette, P.C., Losier-Cool, Mahovlich, Massicotte, Moore, Oliver, Plamondon and Tkachuk (10).

Other senators present: The Honourable Senators Fitzpatrick, Forrestall and Robichaud, P.C. (3).

In attendance: June Dewetering and Jean Dupuis, Analysts, Library of Parliament.

Also present: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, November 18, 2004, the committee continued its consideration of issues dealing with charitable giving in Canada. (See Issue No. 3, December 1, 2004, for the full text of the Order of Reference.)

WITNESSES:

Ducks Unlimited Canada and The Nature Conservancy of Canada:

Barry Turner, Director of Government Relations, Ducks Unlimited Canada;

Brian Gray, Director of Conservation Programs, Ducks Unlimited Canada.

Department of Finance:

Serge Nadeau, Director, Personal Income Tax Division, Tax Policy Branch;

Bill Murphy, Senior Tax Policy Officer, Personal Income Tax Division, Tax Policy Branch.

The Deputy Chair made an opening statement.

Mr. Turner made a statement, and with Mr. Gray, answered questions.

The committee suspended at 4:43 p.m.

The committee resumed at 4:45 p.m.

Mr. Nadeau made a statement and, with Mr. Murphy, answered questions.

The committee suspended at 5:11 p.m.

The committee resumed at 5:13 p.m.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, December 8, 2004, the committee began its consideration of Bill C-5, An Act to provide financial assistance for post-secondary education savings.

APPEARING:

The Honourable Joseph Volpe, P.C., M.P., Minister of Human Resources and Skills Development.

WITNESSES:

Human Resources and Skills Development Canada:

Marie-Josée Thivierge, Assistant Deputy Minister, Human Investment Programs;

Lenore Burton, Director General, Learning and Literacy;

Christian Beaulieu, Senior Counsel, Legal Services, Justice Canada.

Minister Volpe made a statement and, with Ms. Thivierge and Ms. Burton, answered questions.

The committee suspended at 6:18 p.m.

Pursuant to the Order of Reference adopted by the Senate on Thursday, November 18, 2004, the committee continued its consideration of issues dealing with charitable giving in Canada. (See Issue No. 3, December 1, 2004, for the full text of the Order of Reference.)

At 6:20 p.m., the committee proceeded in camera, pursuant to rule 92(2)(f) for the purpose of considering a draft interim report.

It was agreed that the committee consider a draft interim report on Thursday, December 9, 2004.

At 6:35 p.m., the committee adjourned to the call of the Deputy Chair.

Members of the committee present: The Honourable Senators Angus, Grafstein, Gustafson, Harb, Hervieux-Payette, P.C., Massicotte, Meighen, Moore, Oliver, Plamondon, Robichaud, P.C. and Tkachuk (12).

The committee resumed at 12:03 p.m.

Mr. Hutchinson, Mr. Kusie and Mr. Soule made statements and, with Mr. White, answered questions.

The committee suspended at 12:43 p.m.

The committee resumed at 12:46 p.m.

It was moved by Senator Hervieux-Payette, P.C. that the committee move to clause-by-clause consideration of Bill C-5, An Act to provide financial assistance for post-secondary education savings.

The question being put on the motion, it was adopted.

Ms. Burton, answered questions.

It was agreed that consideration of the long title and the short title contained in clause one be postponed, on division.

It was agreed that clause 2 carry on division.

It was agreed that clause 3 carry on division.

It was agreed that clause 3.1 carry on division.

It was agreed that clause 4 carry on division.

It was agreed that clause 5 carry on division.

It was agreed that clause 6 carry on division.

It was agreed that clause 7 carry on division.

It was agreed that clauses 8, 9 and 9.1 carry on division.

It was agreed that clause 10 carry on division.

It was agreed that clauses 11, 12, 13, and 14 carry on division.

It was agreed that clauses 15, 16, 17, 18, 19 and 20 carry on division.

It was agreed that clauses 21, 22 and 23 carry on division.

It was agreed that clause 1, which contains the short title, carry on division.

It was agreed that the title carry on division.

It was agreed that the Bill be adopted without amendment on division.

It was agreed that the Bill be reported, with observations, at the next sitting of the Senate on division.

The committee resumed at 1:13 p.m.

Members of the committee present: The Honourable Senators Angus, Grafstein, Hervieux-Payette, P.C., Massicotte, Moore, Oliver, and Plamondon (7).

In attendance: June Dewetering and Jean Dupuis, Analysts, Library of Parliament.

Pursuant to rule 92(2)(e), the committee considered a draft agenda.

Pursuant to the Order of Reference adopted by the Senate on Thursday, November 18, 2004, the committee continued its consideration of issues dealing with charitable giving in Canada. (See Issue No. 3, December 1, 2004, for the full text of the Order of Reference.)

Pursuant to rule 92(2)(f), the committee considered a draft interim report.

It was moved by the Honourable Senator Oliver that the draft interim report, as amended, be adopted as the report of the committee and that the Chair and Deputy Chair be empowered to approve the final version of the report with any necessary editorial, grammatical or translation changes required.

The question being put on the motion, it was adopted.

At 11:20 p.m., the committee adjourned to the call of the Chair.
