The Standing Senate Committee on Energy, the Environment and Natural Resources met at 9:08 a.m. this day, in Room 705, Victoria Building, the Chair, the Honourable Ronald D. Ghitter, presiding.

Members of the committee present: The Honourable Senators Adams, Buchanan, P.C., Chalifoux, Fitzpatrick, Ghitter, Hays, Kenny, Nolin, Robichaud, P.C. (Saint-Louis-de-Kent), Spivak and Taylor (11).

In attendance: From the Research Branch of the Library of Parliament: Lynne C. Myers and Monique Hébert, Research Officers.

Also in attendance: The official reporters of the Senate.

WITNESSES:

The committee, in compliance with its Order of Reference dated Tuesday, June 8, 1999, continued its examination of Bill C-32, An Act respecting pollution prevention and the protection of the environment and human health in order to contribute to sustainable development. (See proceedings of the committee, Issue No. 19, dated June 15, 1999, for full text of Order of Reference.)

The witnesses made statements, and answered questions.

The witnesses tabled the following documents with the Clerk of the Committee: (1) Regulatory Policy 1995, filed as Exhibit No. 5900 E1/C-32, 20 "5" and (2) Bill C-32 Part 5 -- Assessing Existing Substances and Controlling Toxics, filed as Exhibit No. 5900 E1/C-32, 20 "6".

At 10:38 a.m., the committee suspended sitting.

At 10:53 a.m., the committee resumed sitting.

The witnesses continued to make statements and to answer questions.

At 12:12 p.m., the committee adjourned to 1:30 p.m later this day.

The witnesses continued to make statements and to answer questions.

It was moved by the Honourable Senator Taylor -- That the committee approve the list of witnesses for the period from August 24-September 1, 1999 as outlined in Exhibit No. 5900 E1 C-32, 20 "7".

After debate, the motion was adopted.

It was moved by the Honourable Senator Kenny -- That with respect to Bill C-32, An act respecting pollution prevention and the protection of the environment and human health in order to contribute to sustainable development, the committee shall follow the agreed upon schedule of witnesses and complete its examination of those witnesses no later than Wednesday, September 1, 1999; That if any further witnesses are found to be necessary by the committee following the completion of the said schedule of witnessses, they shall be heard no later than Thursday, September 2, 1999; That any vote on any motion dealing with the disposition of the said bill be held no earlier than at the completion of the hearing of all witnesses; and That the Chair put all questions necessary to dispose of the bill and report the bill to the Senate no later than twelve o'clock noon on Tuesday, September 7, 1999.

After debate, the Honourable Senator Spivak moved -- That the vote on the motion of the Honourable Senator Kenny be deferred until twelve o'clock noon, tomorrow, August 25, 1999.

After debate, the motion of the Honourable Senator Spivak was negatived.

Resuming debate on the motion of the Honourable Senator Kenny.

The motion was adopted on the following division:

YEAS: The Honourable Senators: Adams, Chalifoux, Fitzpatrick, Hays, Kenny, Robichaud, P.C. (Saint-Louis-de-Kent) and Taylor -- 7.

NAYS: The Honourable Senators: Buchanan, P.C., Ghitter, Spivak and Tkachuk -- 4.

ABSTENTIONS: Nil.

At 5:16 p.m., the committee, adjourned to 9:00 a.m. tomorrow, August 25, 1999.
