INTRODUCTION OF THE SPEAKER

The Honourable the Speaker took the Clerk's chair.

The Honourable the Speaker rose and informed the Senate that a Commission had been issued under the Great Seal of Canada appointing him Speaker of the Senate.

The said Commission was then read by the Clerk of the Senate, as follows:

KNOW YOU, that reposing special trust and confidence in your loyalty, integrity and ability, We have constituted and appointed, and We do hereby constitute and appoint you,

TO HAVE, hold, exercise and enjoy the said office of Speaker of the Senate, unto you, Daniel Philip Hays, with all the powers, rights, authority, privileges, profits, emoluments and advantages unto that office of right and by law appertaining during Our Pleasure.

IN TESTIMONY WHEREOF, We have caused these Our Letters to be made Patent and the Great Seal of Canada to be hereunto affixed.

WITNESS:

Our Right Trusty and Well-beloved Adrienne Clarkson, Chancellor and Principal Companion of Our Order of Canada, Chancellor and Commander of Our Order of Military Merit, Governor General and Commander-in-Chief of Canada.

Ordered, That the Mace be carried before the Honourable the Speaker.

The Honourable the Speaker took the Chair at the foot of the Throne, to which he was conducted by the Honourable Senator Carstairs, P.C., and the Honourable Senator Lynch-Staunton.

The Mace was then laid upon the Table.

PRAYERS

The Honourable the Speaker informed the Senate that a communication had been received from the Deputy Secretary to the Governor General.

The Communication was then read by the Honourable the Speaker as follows:

Mr. Speaker:

I am commanded to inform you that the Right Honourable Beverley McLachlin, Chief Justice of the Supreme Court of Canada, in her capacity as Deputy of the Governor General, will proceed to the Chamber of the Senate to open the First Session of the Thirty-seventh Parliament of Canada at 11:00 a.m. on Monday, the 29th day of January, 2001.

The Senate adjourned at pleasure to the call of the bell to resume at approximately 10:55 a.m.

The sitting resumed.

The Senate adjourned during pleasure to await the arrival of the Right Honourable the Deputy of Her Excellency the Governor General.

After awhile, the Right Honourable Beverley Marian McLachlin, Chief Justice of the Supreme Court of Canada, in her capacity as Deputy of Her Excellency the Governor General, having come and being seated at the foot of the Throne-

The Honourable the Speaker commanded the Usher of the Black Rod to proceed to the House of Commons and acquaint that House that:-

"It is the desire of the Right Honourable the Deputy of Her Excellency the Governor General that they attend her immediately in the Senate Chamber."

The House of Commons being come,

The Honourable the Speaker of the Senate said-

"Honourable Members of the Senate:

Members of the House of Commons:

I have the honour to inform you that Her Excellency the Governor General has been pleased to cause Letters Patent to be issued under Her Sign Manual and Signet constituting the Right Honourable Beverley Marian McLachlin, P.C., Chief Justice of the Supreme Court of Canada, her Deputy, to do in Her Excellency's name all acts on her part necessary to be done during Her Excellency's pleasure."

The said Commission was then read by the Deputy Clerk of the Senate as follows:-

BY HER EXCELLENCY the Right Honourable Adrienne Clarkson, Chancellor and Principal Companion of the Order of Canada, Chancellor and Commander of the Order of Military Merit, Governor General and Commander-in-Chief of Canada.

TO THE RIGHT HONOURABLE BEVERLEY MARIAN MCLACHLIN, Chief Justice of the Supreme Court of Canada.

GREETING:

KNOW YOU that being well assured of your loyalty, fidelity and capacity, I, the Right Honourable Adrienne Clarkson, Governor General of Canada, under and by virtue of and in pursuance of the power and authority vested in me by the Commission of Her Majesty Queen Elizabeth II, under the Great Seal of Canada, dated the twenty-eight day of September in the year of Our Lord one thousand nine hundred and ninety-nine, constituting and appointing me to be Governor General of Canada do hereby nominate, constitute and appoint you, Beverley Marian McLachlin, to be my Deputy within Canada and in that capacity to exercise, subject to any limitations or directions from time to time expressed or given by Her Majesty, all the powers, authorities and functions vested in and of right exercisable by me as Governor General, saving and excepting the power of dissolving the Parliament of Canada.

PROVIDED ALWAYS that the appointment of my Deputy shall not affect the exercise of any such power, authority or function by me, the Right Honourable Adrienne Clarkson, in person.

AND PROVIDED ALWAYS, that you, Beverley Marian McLachlin, shall, during your continuance as my Deputy, obey all such orders and instructions as you shall from time to time receive from me.

GIVEN under my hand and seal at Ottawa, this seventh day of January in the year of Our Lord two thousand and in the forty-eighth year of Her Majesty's Reign.

The Honourable the Speaker of the Senate then said-

"Honourable Members of the Senate:

Members of the House of Commons:

I have it in command to let you know that Her Excellency the Governor General does not see fit to declare the causes of her summoning the present Parliament of Canada, until a Speaker of the House of Commons shall have been chosen, according to law; but tomorrow, Tuesday, January 30, 2001, at 2:00 p.m., Her Excellency will declare the causes of her calling this Parliament."

The Commons withdrew.

The Right Honourable the Deputy of Her Excellency the Governor General was pleased to retire.

The sitting resumed.

The Honourable the Speaker informed the Senate that a communication had been received from the Deputy Secretary to the Governor General.

The communication was then read by the Honourable the Speaker as follows:

January 18, 2001

Mr. Speaker:

I have the honour to inform you that Her Excellency the Right Honourable Adrienne Clarkson, Governor General of Canada and His Excellency John Ralston Saul will arrive at the Peace Tower at 14h00 on Tuesday, the 30th day of January, 2001.

When it has been indicated that all is in readiness, Their Excellencies will proceed to the Chamber of the Senate to formally open the First Session of the Thirty-seventh Parliament of Canada.

ADJOURNMENT

The Honourable Senator Robichaud, P.C., moved, seconded by the Honourable Senator Bacon:
