The Standing Senate Committee on Energy, Environment and Natural Resources met at 6:30 p.m. this day, in room 505, Victoria Building, the Honourable Tommy Banks, Chair, presiding.
Members of the committee present: The Honourable Senators Banks, Buchanan, P.C., Christensen, Cochrane, Finnerty, Kenny, Milne, Spivak and Watt (9).
Other senators present: The Honourable Senators Day and Sibbeston (2).
In attendance: From the Library of Parliament: Lynne Myers, Researcher, Science and Technology Division and James McQueen, Researcher, Economics Division.
Also in attendance: The official reporters of the Senate.
Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 22, 2002, the committee proceeded to study Bill C-5, An Act respecting the protection of wildlife species at risk in Canada. In the unavoidable absence of the Chair, the Honourable Senator Milne moved, — That the Honourable Senator Christensen serve as acting Chair until such time as the Chair returns from the chamber.
The question being put on the motion, it was adopted.
Pierre Beauchamp and Mike Buis each made an opening statement and answered questions.
At 7:00 p.m., the Honourable Senator Banks took the Chair.
Stewart Elgie and Kate Smallwood each made an opening statement and answered questions.
At 8:35 p.m. the committee proceeded in camera pursuant to Rule 92(2)(e) for the purpose of considering a draft agenda.
It was agreed, — That the committee hear from officials from the Department of Natural Resources on Bill C-14, An Act providing for controls on the export, import or transit across Canada of rough diamonds and for a certification scheme for the export of rough diamonds in order to meet Canada's obligations under the Kimberley Process, on Tuesday, December 3, 2002.
At 9:02 p.m., it was agreed that the committee adjourn to the call of the Chair.

The Honourable David Anderson made an opening statement.
The Honourable Senator Banks read into the record two letters: one received from the Honourable David Anderson, Minister of the Environment and another from the Honourable Martin Cauchon, Minister of Justice, on the subject of non-derogation clauses. The letters are tabled as Exhibits 5900-2.37/E1-C-5, 5 ``2'' and 5900-2.37/E1-C-5, 5 ``3''.
John Sims made a statement.
Together, Minister Anderson and the witnesses answered questions.
At 10:20 the committee proceeded in camera, pursuant to Rule 92(2)(e) for the purpose of discussing a draft agenda.
It was agreed, — That senators' staff be allowed to stay.
At 10:35 a.m., it was agreed that the committee adjourn to the call of the Chair.
