The Standing Senate Committee on Legal and Constitutional Affairs met this day, in camera, at 4:14 p.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.
Members of the committee present: The Honourable Senators Andreychuk, Bacon, Cools, Eyton, Joyal, P.C, Mercer, Pearson, Ringuette and Sibbeston (9).
Other senator present: The Honourable Senator Lapointe (1).
In attendance: From the Library of Parliament, Margaret Young, Analyst and from the Office of the Law Clerk, Michel Patrice, Parliamentary Counsel.
Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 26, 2004, the committee continued its consideration of Bill S-11. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 3.)
In accordance with rule 92(f), the committee proceeded to consider a draft report.
It was agreed that clause-by-clause consideration of Bill S-11 not take place before March 23, 2005.
At 5:35 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:17 p.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.
Members of the committee present: The Honourable Senators Bacon, Eyton, Joyal, P.C, Lapointe, Léger, Mercer, Milne, Pearson and Rivest (9).
In attendance: From the Library of Parliament, Margaret Young, Analyst and from the Office of the Law Clerk, Michel Patrice, Parliamentary Counsel.
Also in attendance: The official reporters of the Senate.
Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 26, 2004, the committee continued its consideration of Bill S-11. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 3.)
It was agreed that the letters of response from the provinces be printed as an appendix to this day's Minutes of Proceedings. (Available in print format PDF, p. 17.)
At 4:28 p.m., the committee suspended.
At 5:50 p.m., the committee resumed.
It was agreed that the committee proceed to clause-by-clause consideration of Bill S-11.
It was agreed that the title stand postponed.
The Chair asked whether clause 1 shall carry.
The Honourable Senator Lapointe moved that Bill S-11 be amended in clause 1, on page 1, by replacing lines 8 to 17, with the following:
"(b.1) for the purposes of paragraph (1)(a), a game that is operated on or through a video lottery terminal or slot machine, within the meaning of subsection 198(3), situated on premises other than a casino, a race-course or a betting theatre referred to in paragraph 204(8)(e); or"
After debate, the question being put on the motion, it was adopted, on division.
It was agreed that clause 1, as amended, carry, on division.
The Chair asked whether clause 2 shall carry.
The Honourable Senator Joyal moved that Bill S-11 be amended in clause 2, on page 1, by replacing lines 18 to 20, with the following:
"2. This Act comes into force on a day, not later than three years after the day on which it receives royal assent, to be fixed by order of the Governor in Council after the governments of the provinces and territories have been offered an opportunity by the Government of Canada to participate in consultations on its implementation."
After debate, the question being put on the motion, it was adopted, on division.
It was agreed that clause 2, as amended, carry, on division.
It was agreed that the title carry.
It was agreed that the bill, as amended, be adopted, on division.
It was agreed that, in accordance with rule 92(2)(f), the committee proceed in camera to consider a draft report.
It was agreed that the Chair report the bill, as amended and with observations, to the Senate, on division.
At 6:25 p.m., the committee adjourned to the call of the Chair.
