The Special Senate Committee on Anti-terrorism met at 2:08 p.m., this day, in room 160-S, Centre Block, the chair, the Honourable David P. Smith, P.C., presiding.

Members of the committee present: The Honourable Senators Andreychuk, Baker, P.C., Day, Fairbairn, P.C., Nolin, Smith, P.C. and Stratton (7).

In attendance: Laura Barnett, Jennifer Bird and Penny Becklumb, Analysts, Library of Parliament.

Pursuant to the order of reference adopted by the Senate on Wednesday, November 14, 2007, the committee continued its study on Bill S-3, An Act to amend the Criminal Code (investigative hearing and recognizance with conditions). (For complete text of order of reference, see proceedings of the committee, Issue No. 1.)

WITNESS:

Department of Justice Canada:

Yves Parent, Senior Counsel, Criminal Law Policy Section.

It was agreed that the committee proceed to clause-by-clause consideration of Bill S-3.

It was agreed that title stand postponed.

The chair asked if clause 1 shall carry.

The Honourable Senator Nolin moved:

That Bill S-3 be amended in clause 1, on page 2, by replacing lines 15 to 19 with the following:

``information that relates to the offence referred to in subparagraph (i), or that may reveal the whereabouts of an individual who the peace officer suspects may commit the offence referred to''.

After debate, the question being put on the motion, it was adopted.

The committee resumed consideration of the question that clause 1, as amended, carry.

The Honourable Senator Nolin moved:

That Bill S-3 be amended in clause 1, on page 6, by replacing lines 28 to 30 with the following:

``(C) the detention is necessary to main-''.

After debate, the question being put on the motion, it was adopted.

The committee resumed consideration of the question that clause 1, as amended, carry.

Mr. Parent answered questions.

After debate, it was agreed that clause 1, as amended, carry.

It was agreed that clause 2 carry.

The chair asked if clause 3 shall carry.

The Honourable Senator Baker moved:

That Bill S-3 be amended in clause 3, on page 8, by replacing line 40 with the following:

``83.28, 83.29 and 83.3 and their operation shall''.

After debate, Mr. Parent answered questions.

After further debate, the question being put on the motion, it was adopted.

The committee resumed consideration of the question that clause 3, as amended, carry.

It was agreed that clause 3, as amended, carry.

It was agreed that clause 4 carry.

It was agreed that clause 5 carry.

It was agreed that the title carry.

It was agreed that the bill, as amended, carry.

It was agreed that the chair report this bill, as amended, to the Senate.

At 2:32 p.m., the committee suspended.

At 2:34 p.m., pursuant to rule 92(2)(e), the committee resumed in camera, to consider a draft agenda.

At 2:55 p.m., the committee adjourned to the call of the chair.

The Special Senate Committee on Anti-terrorism met this day in camera at 1:30 p.m., in room 160-S, Centre Block, the chair, the Honourable David P. Smith, P.C., presiding.

Members of the committee present: The Honourable Senators Andreychuk, Day, Fairbairn, P.C., Jaffer, Joyal, P.C., Nolin, Segal and Smith, P.C. (8).

In attendance: Jennifer Bird, Analyst, Library of Parliament.

Pursuant to the order of reference adopted by the Senate on Tuesday, March 11, 2008, the committee began its examination on the provisions governing the security certificate process set out in the Immigration and Refugee Protection Act, S.C. 2001, c. 27, as recently modified by An Act to amend the Immigration and Refugee Protection Act (certificate and special advocate) and to make a consequential amendment to another Act, S.C. 2008, c. 3, as well as to conduct a review of the operation of that process in the context of Canada's anti-terrorism framework.

Pursuant to rule 92(2)(e), the committee considered its draft agenda.

At 2:40 p.m., the committee adjourned to the call of the chair.
