The Standing Senate Committee on National Security and Defence met this day at 4:03 p.m., in room 2, Victoria Building, the chair, the Honourable Pamela Wallin, presiding.
Members of the committee present: The Honourable Senators Dallaire, Day, Duffy, Manning, Patterson, Plett, Robichaud and Wallin (8).
Other senator present: The Honourable Senator Nolin (1).

Pursuant to the order of reference adopted by the Senate on Wednesday, March 17, 2010, the committee continued its study on the national security and defence policy of Canada. Rear-Admiral Andrew Smith made a statement and, together with Lieutenant-Colonel Patricia Henry, answered questions.

At 5:03 p.m., pursuant to the order of reference adopted by the Senate on Wednesday, December 15, 2010, the committee continued its consideration of Bill S-13, An Act to implement the Framework Agreement on Integrated Cross-Border Maritime Law Enforcement Operations between the Government of Canada and the Government of the United States of America. It was agreed:
That the committee proceed to clause-by-clause consideration of Bill S-13, An Act to implement the Framework Agreement on Integrated Cross-Border Maritime Law Enforcement Operations between the Government of Canada and the Government of the United States of America.
It was agreed that the title stand postponed.
It was agreed that clause 1, which contains the short title, stand postponed.

The Honourable Senator Manning moved:
That Bill S-13 be amended in Clause 17, page 8 by replacing line 15 with the following:
"45.88 who was appointed as a cross-border maritime law enforcement officer under subsection 8(1) of the Keeping Canadians Safe (Protecting Borders) Act.".
It was agreed that Mr. MacKillop and Ms. Beecher be invited to the table and, during the consideration of Bill S-13, they answered questions from time to time.
After debate, with leave, the Honourable Senator Manning moved in amendment:
That Clause 17, page 8: 45.48 in the French version should read Clause 17, page 8: 45.88
The question being put on the subamendment, it was adopted.
It was agreed that clause 17, as amended, carry.
It was agreed that clause 18 carry.

The chair asked whether clause 22 shall carry.
The Honourable Senator Manning moved:
That Bill S-13 be amended in Clause 22, page 12 by adding after line 22 the following:
"(10) If a complaint concerns the conduct of a designated officer, the Commission may conduct an investigation, review or hearing of that complaint jointly with an authority that is responsible for investigations, reviews or hearings with respect to complaints from the public against law enforcement officers in any relevant jurisdiction, whether in or outside Canada.
(11) The Minister may make regulations respecting investigations, reviews or hearings conducted jointly under subsection (10).",
and
(ii) By replacing lines 23 and 24 with the following:
"45.9 Sections 45.52 to 45.56, 45.63 to 45.67, 45.71, 45.72 and 45.74 to 45.76 apply in respect of a";
(b) Page 19:
(i) By adding after line 32 the following:

The Honourable Senator Manning moved:
That Bill S-13 be amended in Clause 23, page 27 by replacing line 30 with the following:
"45.88 who was appointed as a cross-border maritime law enforcement officer under subsection 8(1) of the Keeping Canadians Safe (Protecting Borders) Act.".
It was agreed that clause 23, as amended, carry.
