The Standing Senate Committee on Legal and Constitutional Affairs, met this day (in camera), in Room 257, East Block, at 1:09 p.m., the Chairman, the Honourable Senator Lorna Milne, presiding.
Members of the committee present: The Honourable Senators Beaudoin, Cogger, Gigantès, Jessiman, Lewis, Losier-Cool, Milne, Moore, Nolin, Pearson and Watt (11).
Other senators present: The Honourable Senator Cools (1).
In attendance: Marilyn Pilon, Research, Research Officer, Research Branch of the Library of Parliament.
Also in attendance: The official reporters of the Senate.
The committee proceeded in camera to discuss the business of the committee.
It was moved by the Honourable Senator Lewis -- THAT the committee resume in public.
The question being put on the motion, it was agreed.
Pursuant to the Order of Reference adopted by the Senate on Thursday, December 11, 1997, at 1:19 p.m. the committee continued its consideration of Bill C-16, An Act to amend the Criminal Code and the Interpretation Act (powers to arrest and enter dwellings).

The Chairman made an opening statement.
Senator Cogger asked a question of the Honourable Anne McLellan.
The Honourable Anne McLellan made a statement and, together with Mr. Yvan Roy and Mr. Michael Zigayer, answered questions.
It was agreed -- THAT the committee complete clause-by-clause consideration of Bill C-16.
It was agreed -- THAT Clause 1 carry.
It was agreed -- THAT Clause 2 carry.
It was agreed -- THAT Clause 3 carry.
It was agreed -- THAT Clause 4 carry.
It was agreed -- THAT the preamble carry.
It was agreed -- THAT the Title carry.
It was agreed -- THAT the Bill carry.
It was agreed -- THAT Bill C-16 be reported to the Senate without amendment.
It was suggested by the Chairman, that the following text be added as an observation to the report on Bill C-16:
This committee has taken note of the events leading to the introduction of this bill before parliament, which have raised concerns among some members. Nevertheless, in the interest of the public good, we have expedited our work on this legislation but hope that the Senate will take the opportunity at an appropriate time to examine some of the important process issues that have been raised.
After debate, it was agreed that the committee only report the bill without amendment.
At 3:27 p.m., the committee adjourned to the call of the Chair.
