The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 257, East Block, at 3:23 p.m., the Chairman, the Honourable Lorna Milne, presiding.

Members of the committee present: The Honourable Senators Beaudoin, Cogger, Doyle, Gigantès, Lewis, Milne, Moore, Pépin and Rossiter (9).

In attendance: Mary Hurley, Research Officer, Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, October 22, 1997, the committee continued its consideration of Bill C-220, An Act to amend the Criminal Code and the Copyright Act (profit from authorship respecting a crime). (See Issue No. 1, Wednesday, October 29, 1997, for full text of Order of Reference.)

WITNESSES:

Ms Tamra Thomson, Director, Legislation and Law Reform;

Mr. Marc-André Blanchard, Chair, Freedom of Expression committee;

Ms Heather Perkins-McVey, Treasurer, Criminal Justice Section.

Ms Wendy Lill, M.P., NDP, Critic for Heritage Canada

The Chairman made an opening statement and paid tribute to Senator Doyle.

After debate,

It was agreed that no action needed to be taken in reply to Mr. Wappel's letter to members of the committee concerning Senator Gigantès.

Ms Tamra Thomson made a statement.

Mr. Marc-André Blanchard and Ms Heather Perkins-McVey each made a statement and, together, answered questions.

Ms Wendy Lill made a statement and answered questions.

At 4:53 p.m., the committee adjourned to the call of the Chair.
