The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 257, East Block, at 3:49 p.m., the Honourable Lorna Milne, Chair, presiding.

Members of the committee present: The Honourable Senators Beaudoin, Bryden, Buchanan, P.C., Fraser, Grafstein, Joyal, P.C., Milne and Pearson (8).

In attendance: David Goetz and Nancy Holmes, Research Officers, Research Branch, Library of Parliament.

Pursuant to the Order of Reference adopted by the Senate on Thursday, December 10, 1998, the committee commenced its consideration of Bill C-40, An Act respecting extradition, to amend the Canada Evidence Act, the Criminal Code, the Immigration Act and the Mutual Legal Assistance in Criminal Matters Act and to amend and repeal other Acts in consequence.

Donald Piragoff, General Counsel, Criminal Law Policy Section.

From Citizenship and Immigration Canada:

Yaron Butovsky, Legal Counsel.

From the Department of Foreign Affairs and International Trade:

Alan Kessel, Director, United Nations Criminal and Treaty Law Division.

The Chair made an opening statement.

Jacques Lemire and Alan Kessel each made a statement and, together with Donald Piragoff, answered questions.

At 5:54 p.m., the committee adjourned to the call of the Chair.
