The Standing Senate Committee on Banking, Trade and Commerce met this day, at 4 p.m., in room 9, Victoria Building, the Chair, the Honourable Jerahmiel S. Grafstein, presiding.
Members of the committee present: The Honourable Senators Biron, Day, Fitzpatrick, Grafstein, Harb, Kelleher, P.C., Massicotte, Meighen and Moore (9).
In attendance: June Dewetering, Acting Principal, and Sheena Starky, Analyst, Library of Parliament.
Also present: The official reporters of the Senate.
Pursuant to the Order of Reference adopted by the Senate on Monday, March 7, 2005, the committee began its consideration of Bill C-29, An Act to amend the Patent Act.
APPEARING:
The Honourable Jerry Pickard, P.C., M.P., Parliamentary Secretary to the Minister of Industry.
WITNESSES:

Jacques Hains, Director, Corporate Strategies Branch, Canadian Intellectual Property Office;
Rob Sutherland-Brown, General Counsel, Intellectual Property Law Group, Legal Services.
The Chair made an opening statement.
The Honourable Jerry Pickard and Mr. Hains made statements and, together with Mr. Sutherland-Brown, answered questions.
It was agreed that the committee move to clause-by-clause consideration of Bill C-29, An Act to amend the Patent Act.
It was agreed to postpone consideration of the long title.
It was agreed that clause 1 carry.
It was agreed that clause 2 carry.
It was moved by Senator Day that Bill C-29 be amended, on page 2, by adding after line 19 the following:
"2.1 The Act is amended by adding, after section 103, Schedules 1 to 4 set out in An Act to amend the Patent Act and the Food and Drugs Act (The Jean Chrétien Pledge to Africa), being chapter 23 of the Statutes of Canada, 2004.''
After debate, the question being put on the motion, it was adopted.
It was moved by Senator Day that Bill C-29 be amended in clause 3, on page 2, by replacing lines 20 and 21 with the following:
"3. (1) Sections 1 and 2.1 come into force on the day on which An Act to amend the Patent Act and the Food and Drugs Act (The Jean Chrétien Pledge to Africa), being chapter 23 of the Statutes of Canada, 2004, comes into force.
(2) Section 2 comes into force on a day to be fixed by order of''.
The question being put on the motion, it was adopted.
It was agreed that clause 3, as amended, carry.
It was agreed that the title carry.
It was agreed that Bill C-29, as amended, be adopted.
It was agreed that Bill C-29 be reported with amendments and without observations at the next sitting of the Senate.
At 4:35 p.m., the committee adjourned to the call of the Chair.
