The Standing Senate Committee on National Security and Defence met this day in camera at 9:45 a.m., in room 7, Victoria Building, the Vice-Chair, the Honourable J. Michael Forrestall, presiding.

Members of the committee present: The Honourable Senators Atkins, Banks, Cools, Day, Forrestall, Kenny, Losier- Cool, Meighen, Munson and Stollery (10).

In attendance: From the Parliamentary Research Branch, Library of Parliament: William Price, Analyst; Inspector Harold O'Connell, RCMP Liaison Officer; Barry Denofsky, National Security Advisor; and William Bishop, Acting Department of National Defence Liaison.

Also present: The official reporters of the Senate.

In accordance with rule 92(2)(e), the committee considered its future agenda.

At 9:53 a.m., Senator Kenny assumed the chair.

At 10:10 a.m., the committee suspended its sitting.

At 10:15 a.m., the committee resumed its sitting in public in room 2, Victoria Building.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, December 7, 2004, the committee continued its examination of Bill C-6, An Act to establish the Department of Public Safety and Emergency Preparedness and to amend or repeal certain Acts. (See Issue No. 12 of the committee's proceedings for the full text of the Order of Reference.)

It was agreed that the committee complete clause by clause consideration of Bill C-6.

It was agreed that clause 35 carry, with Senators Cools, Forrestall and Meighen abstaining.

It was agreed that clause 36 carry, with Senators Cools, Forrestall and Meighen abstaining.

The Chair asked whether clause 37 shall carry.

After debate, the question being put on the motion, it was adopted on the following recorded division:

YEAS: The Honourable Senators Banks, Day, Losier-Cool and Munson — 4.

NAYS: The Honourable Senators Cools, Forrestall and Meighen — 3.

ABSTENTIONS: The Honourable Senators — 0.

It was agreed that clause 37 carry, with Senators Cools, Forrestall and Meighen opposed.

Senator Meighen made a statement.

It was agreed that clause 38 carry, with Senators Cools, Forrestall and Meighen abstaining.

The Chair made a statement.

It was agreed that the title carry, with Senators Cools and Forrestall abstaining.

It was agreed that clause 1 carry, with Senators Cools and Forrestall abstaining.

The Chair asked whether Bill C-6 would be adopted without amendment.

The question being put on the motion, it was adopted on the following recorded division:
