The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:25 p.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.

Members of the committee present: The Honourable Senators Bacon, Cools, Eyton, Joyal, P.C., Mercer, Milne, Pearson, Ringuette and Sibbeston (9).

Other senator present: The Honourable Senator Watt (1).

In attendance: From the Library of Parliament, Margaget Young and Wade Raaflaub, Analysts.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 26, 2004, the committee continued its consideration of Bill S-10, An second Act to harmonize federal law with the civil law of the Province of Quebec and to amend certain Acts in order to ensure that each language version takes into account the common law and the civil law.

The witness made an opening statement and answered questions.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 26, 2004, the committee continued its consideration of Bill S-10, A second Act to harmonize federal law with the civil law of the Province of Quebec and to amend certain Acts in order to ensure that each language version takes into account the common law and the civil law.

It was agreed that the committee proceed to clause-by-clause consideration of Bill S-10.

It was agreed that the title stand postponed.

It was agreed that clause 1 (short title) stand postponed.

It was agreed that clauses 2 to 6 carry.

It was agreed that clauses 7 to 103 carry.

It was agreed that clauses 104 to 145 carry.

It was agreed that clauses 146 to 181 carry.

It was agreed that clauses 182 to 204 carry.

It was agreed that clauses 205 to 208 carry.

It was agreed that clause 1 carry.

It was agreed that the title carry.

It was agreed that this Bill be adopted without amendment.

At 4:30 p.m., in accordance with rRule 92(f), the committee proceeded in camera to consider a draft report.

It was agreed that staff be permitted to remain during the in camera session.

At 4:50 p.m., the committee resumed in public.

It was agreed that observations be appended to the report.

It was agreed that the Chair report this Bill without amendment, but with observations, at the next sitting of the Senate.

At 4:52 p.m., the committee adjourned to the call of the Chair.
