The Standing Senate Committee on Rules, Procedures and the Rights of Parliament met in camera, at 9:05 a.m., this day, in room 356-S, Centre Block, the Chair, the Honourable David P. Smith, P.C., presiding.

Members of the committee present: The Honourable Senators Andreychuk, Chaput, Cools, Fraser, Furey, Jaffer, Joyal, P.C., Kinsella, LeBreton, Lynch-Staunton, Maheu, Robichaud, P.C., Smith, P.C. and Stratton (14).

Pursuant to its mandate under rule 86(1)(f), consideration of a draft report on a Conflict of Interest Code for Senators.

Pursuant to rule 92(2)(f), the meeting was held in camera.

It was agreed to allow staff to remain.

Senator Fraser presented to the committee the draft report on a Conflict of Interest Code for Senators with explanations.

It was agreed that staff temporarily leave the room and that no transcripts be taken.

A discussion on the issues raised at the two special meetings last week was held.

At 10:56 a.m. staff were invited to rejoin the in camera deliberations and transcription be re-commenced.

The Honourable Senator Fraser moved:

That a drafting committee comprised of the Honourable Senators Di Nino, Fraser and Smith be authorized to revise the draft Conflict of Interest Code, in the light of discussions in committee, and the written submissions of senators, and that necessary funds for working meals and refreshments be allocated, as needed.

The question being put on the motion, it was adopted.

At 11:02 a.m. the committee adjourned to the call of the Chair.

The Chair made introductory remarks, presenting a draft report from the drafting committee on a Conflict of Interest Code for Senators.

Senator Fraser made a detailed presentation on the draft.

A discussion of the draft followed.

It was agreed that the Clerk of the Committee consult the Procedural Team with an eye towards any procedural elements that may need to be considered.

It was agreed to continue consideration of the draft code at the next meeting of the committee.

It was agreed to consult the respective party whips to identify the earliest opportunity for a confidential briefing opportunity for all senators.

Dr. O'Brien explained a draft of rule changes to the Rules of the Senate consequential to the Conflict of Interest Code for Senators.

It was agreed to distribute the draft code to offices of senators on a confidential and expedited basis.
