The Standing Senate Committee on Energy, the Environment and Natural Resources met this day in camera at 5:44 p.m., in room 257, East Block, the Chair, the Honourable Tommy Banks, presiding.

Members of the committee present: The Honourable Senators Banks, Lavigne, Milne, Mitchell and Spivak (5).

Other senator present: The Honourable Senator McCoy (1).

In attendance: From the Research Branch of the Library of Parliament: Lynne Myers and Sam Banks, Analysts.

Also in attendance: The official reporters of the Senate.

Pursuant to rule 92(2)(e), the committee proceeded to consider a draft agenda.

It was agreed that staff be permitted to remain for the in camera meeting.

A discussion of issues related to the mandate of the committee took place.

It was agreed that the committee adopt the proposed draft work plan.

It was agreed that the committee proceeded to consider a draft report on the review of the Canadian Environment Protection Act.

Pursuant to the Order of Reference adopted by the Senate on Thursday, April 27, 2006, the committee continued its review of the Canadian Environmental Protection Act (1999, c. 33) pursuant to section 343(1) of the said act. The committee considered a draft report.

At 7:13 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Energy, the Environment and Natural Resources met this day at 8:35 a.m., in room 257, East Block, the Chair, the Honourable Tommy Banks, presiding.

Members of the committee present: The Honourable Senators Adams, Banks, Lavigne, Milne, Mitchell and Spivak (6).

Other senator present: The Honourable Senator McCoy (1).

In attendance: From the Research Branch of the Library of Parliament: Lynne Myers, Kristen Douglas and Sam Banks, Analysts.

Pursuant to the Order of Reference adopted by the Senate on Thursday, December 14, 2006, the committee began its study on Bill S-209, concerning personal watercraft in navigable waters.

It was agreed that the committee proceed to clause-by-clause consideration of Bill S-209, concerning personal watercraft in navigable waters.

It was agreed that the title stand postponed.

It was agreed that the preamble stand postponed.

It was agreed that clause 1, which contains the short title, stand postponed.

It was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

It was agreed that clause 5 carry.

It was agreed that clause 6 carry.

It was agreed that clause 7 carry.

It was agreed that clause 8 carry.

It was agreed that clause 9 carry.

It was agreed that clause 10 carry.

It was agreed that clause 11 carry.

It was agreed that clause 1, which contains the short title, carry.

It was agreed that the preamble carry.

At 8:40 a.m., pursuant to rule 92(2)(f), the committee proceeded in camera to consider a draft report.

Senator Spivak moved that staff be permitted to remain for the in camera meeting.

The question being put on the motion, it was adopted.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, December 13, 2006, the committee continued its study on Bill S-210, to amend the National Capital Act (establishment and protection of Gatineau Park). (For complete text of Order of Reference, see proceedings of the committee, Issue No. 15.)

The Chair made an opening statement.

Mr. Perras, Ms. Couture-MacTavish and Mr. Frank each made a presentation and answered questions.

The Chair made a closing statement.

DECLARATION OF PRIVATE INTERESTS

Pursuant to subsection 14(1) of the Conflict of Interest Code for Senators, a declaration of private interest was made as follows:

- By written declaration, the Honourable Senator Kenny (Bill S-210 An Act to amend the National Capital Act (establishment and protection of Gatineau Park).

Pursuant to the Order of Reference adopted by the Senate on Wednesday, December 13, 2006, the committee continued its study on Bill S-210, to amend the National Capital Act (establishment and protection of Gatineau Park). The Chair made an opening remark.

The Honourable Senator Milne moved that the committee proceed to clause-by-clause consideration of Bill S-210, to amend the National Capital Act (establishment and protection of Gatineau Park).

The question being put on the motion, it was adopted.

It was agreed that the title stand postponed.

It was agreed that the preamble stand postponed.

It was agreed that clause 1, carry.

It was agreed that clause 2 carry.

It was agreed that clause 2.1 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

The Chair asked whether clause 5 shall carry.

The Honourable Senator Spivak moved:

That Bill S-210 be amended in clause 5, on page 4, by replacing line 3 with the following:

"Park to anyone other than the Commission unless the person has given the right of".

After debate, the question being put on the motion in amendment, it was adopted on division.

It was agreed that clause 5, as amended, carry on division.

It was agreed that clause 6 carry.

It was agreed that clause 7 carry.

It was agreed that clause 8 carry.

It was agreed that clause 9 carry.

It was agreed that clause 10 carry.

It was agreed that the committee revert to clause 4.

The Honourable Senator Spivak moved:

That Bill S-210 be amended in clause 4 on page 2 by:

(a) Replacing line 32 with the following:

"10.1 (1) There is hereby established a park"; and

(b) Adding after line 34 the following:

"(2) Gatineau Park is hereby dedicated to the people of Canada for their benefit, education and enjoyment, subject to this Act and the regulations, and it shall be maintained and made use of so as to leave it unimpaired for the enjoyment of future generations.

(3) Maintenance or restoration of ecological integrity, through the protection of natural resources and natural processes, shall be the first priority of the Commission when considering all aspects of the management of Gatineau Park.".

After debate, the question being put on the motion in amendment, it was adopted.

It was agreed that clause 4, as amended, carry.

The Chair asked whether the preamble shall carry.

After debate, it was agreed that the preamble carry on division.

It was agreed that the schedule carry.

It was agreed that the title carry, on division.

It was agreed that the Bill carry, on division.

It was agreed that the Chair report the Bill to the Senate with amendments and an observation, on division.

At 9:02 a.m., the committee suspended.

At 9:03 a.m., pursuant to rule 92(2)(f), the committee proceeded in camera to consider a draft report.

It was agreed that staff be permitted to remain for the in camera meeting.

It was agreed that the proposed observation be appended to the report.

At 9:10 a.m., the committee adjourned to the call of the Chair.
