The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10 a.m., in room 2, Victoria Building, the Honourable Donald H. Oliver, Chair, presiding.

Members of the committee present: The Honourable Senators Baker, P.C., Campbell, Cools, Day, Fox, P.C., Hays, Joyal, P.C., Milne, Oliver, and Zimmer (10).

Other senators present: The Honourable Senators Stratton and Carstairs, P.C. (2).

In attendance: Kristen Douglas and Alex Smith, Analysts, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, June 27, 2006, the committee continued its consideration of Bill C-2, An Act providing for conflict of interest rules, restrictions on election financing and measures respecting administrative transparency, oversight and accountability. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 3).

WITNESSES:

As an individual:

James R. Mitchell, Partner, Sussex Circle.

Citizens' Circle for Accountability:

Henry E. McCandless, General Convenor.

The Chair made an opening statement.

Mr. Mitchell and Mr. McCandless each made statements and answered questions.

The Honourable Senator Milne moved that any consideration of votes on any motions dealing with the disposition in committee of Bill C-2, An Act providing for conflict of interest rules, restrictions on election financing and measures respecting administrative transparency, oversight and accountability, be held no earlier that the completion of hearing all witnesses.

After debate, it was agreed that debate be adjourned until the next meeting of the committee.

At 12:15 p.m., the committee adjourned to the call of the Chair.

Peter Aucoin, Professor, Department of Political Science and School of Public Administration, Dalhousie University;

Leslie A. Pal, Professor of Public Policy and Administration, Carleton University.

The Chair made an opening statement.

Mr. Franks and Mr. Aucoin each made statements and answered questions.

The committee resumed debate on the motion of the Honourable Senator Milne that any consideration of votes on any motions dealing with the disposition in committee of Bill C-2, An Act providing for conflict of interest rules, restrictions on election financing and measures respecting administrative transparency, oversight and accountability, be held no earlier that the completion of hearing all witnesses.

After debate, the Honourable Senator Stratton moved that the motion be amended by adding the following at the end: ``and that Bill C-2 be reported back to the Senate no later than the afternoon session of the Senate on Tuesday, September 26, 2006''.

After debate, it was, with leave, agreed that the Honourable Senator Stratton's motion be withdrawn and considered later as a separate motion.

Debate resumed on the motion of the Honourable Senator Milne. The question being put on the motion, it was adopted by a show of hands.

The Honourable Senator Stratton moved that Bill C-2 be reported back to the Senate no later than the afternoon session of Tuesday, September 26, 2006.

The question being put on the motion, it was negatived by a show of hands.

At 4 p.m., the committee suspended.

At 4:10 p.m., the committee resumed.

The Chair made a statement.

Mr. Pal made a statement and answered questions.

At 5:30 p.m., the committee adjourned to the call of the Chair.
