The Standing Senate Committee on Legal and Constitutional Affairs met this day at 4:05 p.m., in room 2, Victoria Building, the Chair, the Honourable Donald H. Oliver, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Baker, P.C., Bryden, Jaffer, Joyal, P.C., Milne, Nolin and Oliver (8).

In attendance: Robin MacKay and Dominique Valiquet, Analysts, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, November 21, 2006, the committee began its consideration of Bill C-19, to amend the Criminal Code (street racing) and to make a consequential amendment to the Corrections and Conditional Release Act.

APPEARING:

The Honourable Vic Toews, P.C., M.P., Minister of Justice and Attorney General of Canada.

WITNESSES:

Department of Justice Canada:

Catherine Kane, Acting Senior General Counsel, Criminal Law Policy Section;

Hal Pruden, Counsel, Criminal Law Policy Section.

The Chair made an opening statement.

Mr. Toews made a statement and, with Ms. Kane and Mr. Pruden, answered questions.

At 5:12 p.m., the Honourable Senator Milne assumed the Chair.

At 5:45 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10:45 a.m., in room 257, East Block, the Chair, the Honourable Donald H. Oliver, Chair, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Baker, P.C., Di Nino, Joyal, P.C., Milne, Nolin, Oliver, Rivest, Stratton and Zimmer (10).

In attendance: Robin MacKay and Dominique Valiquet, Analysts, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, November 21, 2006, the committee continued its consideration of Bill C-19, to amend the Criminal Code (street racing) and to make a consequential amendment to the Corrections and Conditional Release Act.

The Chair made an opening statement.

Mr. Robertson, Mr. Johnstone, Mr. Ellsworth and Mr. Giannou each made statements and answered questions.

At 12:20 p.m., the committee suspended.

At 12:24 p.m., the committee resumed.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-19, to amend the Criminal Code (street racing) and to make a consequential amendment to the Corrections and Conditional Release Act.

It was agreed that the title stand postponed.

It was agreed that clause 1 carry.

It was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

It was agreed that clause 5 carry.

It was agreed that clause 6 carry.

It was agreed that the committee append observations to the report.

It was agreed that the Chair and Deputy Chair be empowered to approve the final version of the observations being appended to the report taking into consideration today's discussion and with any necessary editorial, grammatical or translation changes required.

It was agreed that the bill be reported without amendment and with observations.

At 12:33 p.m., the committee adjourned to the call of the Chair.
