The Standing Senate Committee on Legal and Constitutional Affairs met this day at 4:07 p.m., in room 257, East Block, the Deputy Chair, the Honourable Lorna Milne, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Baker, P.C., Fraser, Jaffer, Joyal, P.C., Milne, Nolin and Stratton (8).

In attendance: Robin MacKay and Wade Riordan Raaflaub, Analysts, Parliamentary Information and Research Services, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, February 27, 2007, the committee continued its consideration of Bill C-9, to amend the Criminal Code (conditional sentence of imprisonment). (For complete text of Order of Reference, see proceedings of the committee, Issue No. 23.)

Pierre-Paul Pichette, Assistant Director, Chief of Service, Corporate Operations Service.

Association des services de réhabilitation du Québec:

Patrick Altimas, Managing Director;

Jean-François Cusson, Coordinator, Programs and Communications.

The Deputy Chair made an opening statement.

Mr. Rady, Ms. Joncas, Mr. Trudeau and Mr. Silverstein each made a statement and, together, answered questions.

At 5:18 p.m., the committee suspended.

At 5:22 p.m., the committee resumed.

Mr. Pichette, Mr. Brabant and Mr. Altimas each made a statement and, together with Mr. Cusson, answered questions.

It was agreed that the Clerk may release the letter received from the premier of New Brunswick in regards to the committee's consideration of Bill S-4, to amend the Constitution Act, 1867 (Senate tenure) to media, if requested.

At 6:32 p.m., the committee adjourned to the call of the Chair.

Members of the committee present: The Honourable Senators Andreychuk, Baker, P.C., Bryden, Fraser, Jaffer, Joyal, P.C., Milne, Nolin and Stratton (9).

Pursuant to the Order of Reference adopted by the Senate on Tuesday, February 27, 2007, the committee continued its consideration of Bill C-9, to amend the Criminal Code (conditional sentence of imprisonment). It was agreed that the committee proceed to clause-by-clause consideration of Bill C-9, an Act to amend the Criminal Code (conditional sentence of imprisonment).

It was agreed that the title stand postponed.

It was agreed that clause 1 carry, on division.

It was agreed that clause 2 carry, on division.

It was agreed that the title carry.

It was agreed that the bill carry, on division.

It was agreed that the bill be reported without amendment but with observations at the next sitting of the Senate.

It was agreed that the committee continue in camera pursuant to rule 92(2)(f) to discuss draft observations to the report on Bill C-9.

It was agreed to permit member's staff, committee staff, Senate reporters and Department of Justice officials to remain during the in camera proceedings.

At 10:55 a.m., the committee continued in camera.

At 11:10 a.m., the committee suspended.

At 11:20 a.m., the committee resumed.

At 11:31 a.m., the committee adjourned to the call of the Chair.
