The Standing Senate Committee on Transport and Communications met this day, at 9:30 a.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.

Members of the committee present: The Honourable Senators Adams, Bacon, Champagne, P.C., Dawson, Eyton, Mercer, Merchant, Munson, Phalen, Tkachuk and Zimmer (11).

Other senators present: The Honourable Senators Joyal, P.C. and Milne (2).

In attendance: From the Library of Parliament: Allison Padova, Analyst.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 24, 2006, the committee continued its consideration of Bill C-3, respecting international bridges and tunnels and making a consequential amendment to another act. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 5).

WITNESSES:

Dan Stamper, President;

Skip McMahon, Executive Director of External Affairs.

Centra Inc.:

Matthew Moroun, Vice-Chairman.

Mr. Stamper and Mr. Moroun each made opening statements and, together with Mr. McMahon, answered questions.

At 11:05 a.m., the committee adjourned to the call of the Chair.

After debate, Ms. Marcoux answered questions.

The Honourable Senator Mercer moved that clause-by-clause consideration of Bill C-3 be postponed.

The question being put on the motion, it was defeated on the following division:

YEAS: The Honourable Senators Dawson, Mercer, Munson and Zimmer (4).

NAYS: The Honourable Senators Adams, Bacon, Champagne, P.C., Johnson, Phalen, Stratton and Tkachuk (7).

It was agreed that the Committee proceed to clause-by-clause consideration of Bill C-3.

It was agreed that the title stand postponed.

It was agreed that clause 1 (short title) stand postponed.

It was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

It was agreed that clause 5 carry.

It was agreed that clause 6 carry.

The Chair asked if clause 7 shall carry.

The Honourable Senator Champagne, P.C., moved that Bill C-3 be amended in clause 7, on page 3, by replacing lines 9 to 11 with the following:

"of government that have jurisdiction over the place of the proposed construction or alteration and with person who, in the ".

After debate, the question being put on the motion in amendment, it was adopted.

It was agreed that clause 7 as amended carry.

It was agreed that clause 8 carry.

It was agreed that clause 9 carry.

It was agreed that clause 10 carry.

It was agreed that clause 11 carry.

It was agreed that clause 12 carry.

It was agreed that clause 13 carry.

It was agreed that clause 14 carry.

The Chair asked if clause 15 shall carry.

The Honourable Senator Champagne, P.C., moved that Bill C-3 be amended in clause 15, on page 7, by replacing, in the French version, lines 35 and 36 with the following:

"gouvernement provincial et la municipalité ayant compétence à l'égard de tout.".

After debate, the question being put on the motion in amendment, it was adopted.

It was agreed that clause 15 as amended carry.

It was agreed that clause 15.1 carry.

It was agreed that clause 16 carry.

It was agreed that clause 17 carry.

It was agreed that clause 18 carry.

It was agreed that clause 19 carry.

The Honourable Senator Mercer moved that Bill C-3 be amended in clause 57, on page 24, by replacing line 18 with the following:

"This Act does not apply ".

After debate, the question being put on the motion, it was defeated on the following division:

YEAS: The Honourable Senators Dawson, Mercer, Munson, Phalen and Zimmer (5).

NAYS: The Honourable Senators Adams, Bacon, Champagne, P.C., Johnson, Stratton and Tkachuk (6).

It was agreed that clause 57 carry.

It was agreed that clause 58 carry.

It was agreed that clause 59 carry.

It was agreed that clause 60 carry.

It was agreed that the schedule carry.

It was agreed that clause 1 carry.

It was agreed that the title carry.

The committee resumed consideration of clause 56.

Mr. Patrice answered questions.

After debate, it was agreed that clause 56 carry.

It was agreed that the bill be adopted as amended.

The Honourable Senator Tkachuk moved that the draft observations be appended to the report.

The question being put on the motion, it was adopted.

It was agreed that the Chair report the bill as amended and with observations to the Senate.

At 10:45 a.m., the committee adjourned to the call of the Chair.
