The Standing Senate Committee on Legal and Constitutional Affairs met this day at 4:06 p.m., in room 257, East Block, the chair, the Honourable Joan Fraser, presiding.

Members of the committee present: The Honourable Senators Angus, Baker, P.C., Carignan, Fraser, Joyal, P.C., Mercer, Milne, Nolin, Rivest, Wallace and Watt (11).

In attendance: Jennifer Bird and Robin MacKay, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Thursday, September 17, 2009, the committee continued its consideration of Bill C-15, An Act to amend the Controlled Drugs and Substances Act and to make related and consequential amendments to other acts. (For complete text of the order of reference, see proceedings of the committee, Issue No. 15.)

WITNESSES:

Eugene Oscapella, Professor, University of Ottawa, Department of Criminology.

Surrey Fire Services:

Chief Len Garis.

City of Langley, BC:

His Worship Peter Fassbender, Mayor.

Canadian Police Association (CPA):

Charles Momy, President;

Ray Massicotte, Member of Board of Directors of CPA.

As an individual:

Justice Micheline Corbeil-Laramée (retired).

The chair made an opening statement.

Ms. Roy and Mr. Oscapella each made a statement and, together, answered questions.

At 5:22 p.m., the committee suspended.

At 5:26 p.m., the committee resumed.

Mr. Momy, Chief Len Garis and His Worship Peter Fassbender each made a statement and, together with Mr. Massicotte, answered questions.

The Honourable Senator Baker, P.C., moved that the written submission of Chief Len Garis be appended to the committee proceedings (see Appendix 5900-2.40/L1-C-15, 18 ``7'').

The question being put on the motion, it was adopted.

At 6:41 p.m., the committee suspended.

At 6:47 p.m., the committee resumed.

Justice Micheline Corbeil-Laramée made a statement and answered questions.

At 7:23 p.m., the committee adjourned to the call of the chair.

Members of the committee present: The Honourable Senators Angus, Banks, Carignan, Joyal, P.C., Mercer, Milne, Nolin and Wallace (8).

In attendance: Jennifer Bird and Robin MacKay, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

At 12:49 p.m., the committee resumed.

The Honourable Senator Milne moved that for documents that are available on the internet, the URL for the documents, rather than the documents themselves, be appended to the committee proceedings.

The question being put on the motion, it was adopted.

At 12:50 p.m., the committee adjourned to the call of the chair.
