The Standing Senate Committee on Transport and Communications met this day, at 6:31 p.m., in room 256-S, Centre Block, the chair, the Honourable Lise Bacon, presiding.
Members of the committee present: The Honourable Senators Bacon, Dawson, Housakos, Johnson, Meighen, Mercer, Merchant and Zimmer (8).
In attendance: Terrence Thomas, Analyst, Parliamentary Information and Research Service, Library of Parliament.
Aso in attendance: The official reporters of the Senate.
Pursuant to the order of reference adopted by the Senate on Tuesday, March 24, 2009, the committee continued its study on the emerging issues related to its communications mandate and to report on the wireless sector. (For complete text of the order of reference, see proceedings of the committee, Issue No.1.)

Pursuant to the order of reference adopted by the Senate on Tuesday, April 28, 2009, the committee began its examination of Bill C-9, An Act to amend the Transportation of Dangerous Goods Act, 1992.
APPEARING:

Brian Jean, M.P., Parliamentary Secretary to the Minister of Transport, Infrastructure and Communities.

Marie-France Dagenais, Director General, Transportation of Dangerous Goods.
The Honourable John Baird made a statement and, together with Brian Jean, Peter Coyles and Marie-France Dagenais, answered questions.
At 7:51 p.m., the committee suspended.
At 7:54 p.m., the committee resumed.
It was agreed that the committee proceed to clause-by-clause consideration of Bill C-9, An Act to amend the Transportation of Dangerous Goods Act, 1992.
With leave, it was agreed that the committee be allowed to group several clauses together for the purpose of clause by clause consideration of Bill C-9.
It was agreed that the title stand postponed.
It was agreed that clauses 1 to 28 carry.
The Chair asked whether clause 29 shall carry.
It was moved by the honourable Senator Mercer that Bill C-9 be amended in clause 29, on page 26, by adding after line 36 the following:
"(4) The Standing Senate Committee on Transport and Communications or, if there is not a Standing Senate Committee on Transport and Communications, the appropriate committee of the Senate may review any regulations made under this Act, either on its own initiative or on receiving a written complaint regarding a specific safety concern. The committee may hold public hearings and may table its report on its review in the Senate.''
The question being put on motion in amendment, it was adopted.
It was agreed that clause 29, as amended, carry.
It was agreed that clauses 30 to 37 carry.
It was agreed that clause 1 carry.
It was agreed that the title carry.
It was agreed that the bill as amended, carry.
It was agreed that the chair report the bill, with amendment, to the Senate at the earliest opportunity.
At 7:58 p.m., the committee adjourned to the call of the chair.
