The Special Senate Committee on Anti-terrorism met this day at 1:30 p.m., in room 9, Victoria Building, the chair, the Honourable Hugh Segal, presiding.
Members of the committee present: The Honourable Senators Andreychuk, Dagenais, Dallaire, Day, Frum, Joyal, P.C., Peterson, Segal and Tkachuk (9).
In attendance: Lyne Casavant, Holly Porteous and Dominique Valiquet, Analysts, Parliamentary Information and Research Service, Library of Parliament.
Also in attendance: The official reporters of the Senate.
Pursuant to the order of reference adopted by the Senate on Thursday, March 8, 2012, the committee continued its examination of Bill S-7, An Act to amend the Criminal Code, the Canada Evidence Act and the Security of Information Act. (For complete text of the order of reference, see proceedings of the committee, Issue No. 1.)

It was agreed that the committee proceed to clause-by-clause consideration of Bill S-7, An Act to amend the Criminal Code, the Canada Evidence Act and the Security of Information Act.
It was agreed that the title stand postponed.
It was agreed that clause 1, which contains the short title, stand postponed.
It was agreed that clause 2 carry.
It was agreed that clause 3 carry.
It was agreed that clause 4 carry.
It was agreed that clause 5 carry.
It was agreed that clause 6 carry.
It was agreed that clause 7 carry.
It was agreed that clause 8 carry.
It was agreed that clause 9 carry.
The chair asked whether clause 10 shall carry.
The Honourable Senator Frum moved:
That Bill S-7 be amended in clause 10, page 10, by replacing line 36 with the following:
"(13) The judge, or any other judge of the same court, may, on application of the".
After debate, the question being put on the motion in amendment, it was adopted.
It was agreed that clause 10, as amended, carry.
It was agreed that clause 11, carry.
The chair asked whether clause 12 shall carry.
The Honourable Senator Frum moved:
That Bill S-7 be amended in clause 12, page 11:
(a) by replacing, in the French version, line 27 with the following:
"83.28, 83.29 et 83.3 et de leur application doit"; and
(b) by replacing, in the French version, line 31 with the following:
"cas, désigne ou constitue à cette fin.".
After debate, the question being put on the motion in amendment, it was adopted.
It was agreed that clause 12, as amended, carry.
It was agreed that clause 13 carry.

After debate,
It was agreed that the Subcommittee on Agenda and Procedure be empowered to approve the final version of the observations being appended to the report, taking into consideration the committee's discussion and any necessary editorial, grammatical or translation changes as required.
It was agreed that the chair report the bill, as amended and with observations, to the Senate.
It was agreed that the letter and brief from the Canadian Bar Association be appended to the minutes.
At 3:05 p.m., the committee adjourned to the call of the chair.
