The Standing Senate Committee on Aboriginal Peoples met this day, at 6:47 p.m., in room 160-S, Centre Block, the chair, the Honourable Vernon White, presiding.

Members of the committee present: The Honourable Senators Ataullahjan, Beyak, Campbell, Demers, Dyck, Hubley, Lovelace Nicholas, Patterson, Raine, Seth, Watt and White (12).

In attendance: Shauna Troniak and Wren Nasr, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Thursday, December 13, 2012, the committee continued its consideration of Bill C-27, An Act to enhance the financial accountability and transparency of First Nations. (For complete text of the order of reference, see proceedings of the committee, Issue No. 31.)

The chair asked whether the committee agreed to proceed to clause-by-clause consideration of Bill C-27, An Act to enhance the financial accountability and transparency of First Nations.

The Honourable Senator Dyck moved:

That Bill C-27: The First Nations Financial Transparency Act be withdrawn by the Sponsor in the Senate, and the Minister of Aboriginal Affairs and Northern Development; and That the Minister of Aboriginal Affairs and Northern Development initiate a process, agreed to by the Assembly of First Nations, to consult and accommodate First Nations who will be affected by this bill.

After debate, the question being put on the motion, it was negatived on the following vote:

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-27, An Act to enhance the financial accountability and transparency of First Nations.

It was agreed that the title stand postponed.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

It was agreed that clause 5 carry.

The chair asked whether clause 8 shall carry.

The Honourable Senator Dyck moved:

That Bill C-27 be amended in clause 8(2), on page 4, by replacing ``public'' on line 10 with ``member.''

After debate, the question being put on the motion, it was negatived by a show of hands.

It was agreed that clause 8 carry.

The chair asked whether clause 9 shall carry.

The Honourable Senator Dyck moved:

That Bill C-27 be amended in clause 9, on page 4, by deleting lines 16 to 22.

After debate, the question being put on the motion, it was negatived by a show of hands.

It was agreed that clause 9 carry.

It was agreed that clause 10 carry.

The chair asked whether clause 11 carry.

The Honourable Senator Dyck moved:

That Bill C-27 be amended in clause 11, on page 4, by deleting ``any person, including'' on line 30.

After debate, the question being put on the motion, it was negatived by a show of hands.

It was agreed that clause 11 carry, on division.

It was agreed that clause 12 carry.

The chair asked whether clause 13 shall carry.

The Honourable Senator Dyck moved:

That Bill C-27 be amended in clause 13(b), on page 5, replacing lines 7-15, with:

(b) withhold discretionary moneys payable within an existing grant or contribution to the First Nation, including but not limited to the Band Support Funding, under an agreement that is in force on the day on which the breach occurs and that is entered into by the First Nation and Her Majesty in right of Canada as represented by the Minister, solely or in a combination with other ministers of the Crown, until the First Nation has complied with its duty.

After debate, the question being put on the motion, it was negatived by a show of hands.

The Honourable Senator Dyck moved:

That Bill C-27 be amended in clause 13(c), on page 5, by deleting lines 16 and 17.

After debate, the question being put on the motion, it was negatived by a show of hands.

It was agreed that clause 13 carry, on division.

It was agreed that clause 1 carry, on division.

It was agreed that the title carry, on division.

It was agreed that the bill, carry, on division.

The chair asked whether the committee wished to append observations to the report.

After debate, it was agreed that the committee not append observations to the report.

It was agreed, on division, that the chair report the bill to the Senate.

At 8:12 p.m., the committee suspended.

Pursuant to the order of reference adopted by the Senate on Thursday, June 16, 2011, the committee continued its consideration of the federal government's constitutional, treaty, political and legal responsibilities to First Nations, Inuit and Metis peoples and other matters generally relating to the Aboriginal Peoples of Canada. At 8:20 p.m., pursuant to rule 12-16(1)(d), the committee resumed in camera to consider a draft agenda (future business).

It was agreed that senators' staff be permitted to stay.

At 8:55 p.m., it was agreed that the committee adjourn to the call of the chair.
