The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10:30 a.m., in room 257, East Block, the chair, the Honourable Bob Runciman, presiding.

Members of the committee present: The Honourable Senators Angus, Baker, P.C., Boisvenu, Chaput, Dagenais, Di Nino, Fraser, Jaffer, Merchant, Runciman, Unger and White (12).

In attendance: Erin Shaw, Analyst, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Tuesday, May 15, 2012, the committee continued its consideration of Bill C-310, An Act to amend the Criminal Code (trafficking in persons). (For complete text of the order of reference, see proceedings of the committee, Issue No. 20.)

WITNESSES:

Department of Justice Canada:

Matthew Taylor, Counsel, Criminal Law Policy Section.

Public Safety Canada:

Yves Leguerrier, Director, Serious and Organized Crime Division.

Royal Canadian Mounted Police:

Superintendent Shirley Cuillierrier, Immigration and Passports;

Sergeant Marie-Claude Arsenault, Non Commissioned Officer in charge of the Human Trafficking National Coordination Centre.

The chair made an opening statement.

Mr. Taylor, Mr. Leguerrier, Supt. Cuillierrier each made an opening statement and, together with Sgt. Arsenault, answered questions.

At 11:31 a.m., the committee suspended.

At 11:39 a.m., the committee resumed.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-310, An Act to amend the Criminal Code (trafficking in persons).

It was agreed that the title stand postponed.

It was agreed that clause 1 carry.

It was agreed that clause 2 carry.

It was agreed that the title carry.

It was agreed that the bill carry.

At 11:40 a.m., it was agreed that the committee continue in camera, pursuant to rule 92(2)(f) to consider a draft report (observations).

It was agreed that senators' staff be allowed to remain in the room for the in camera portions of today's meeting.

Debate arose thereon.

At 11:50 a.m., the committee continued in public.

After debate, it was agreed that the chair report the bill to the Senate.

At 11:51 a.m., the deputy chair, the Honourable Senator Fraser, took the chair.

Pursuant to the order of reference adopted by the Senate on Thursday, April 26, 2012, the committee continued its consideration of Bill S-209, An Act to amend the Criminal Code (prize fights).

WITNESS:

Department of Justice Canada:

Catherine Kane, Director General and Senior General Counsel, Criminal Law Policy Section.

It was agreed that the committee proceed to clause-by-clause consideration of Bill S-209, An Act to amend the Criminal Code (prize fights).

It was agreed that the title stand postponed.

The deputy chair called clause 1.

The Honourable Senator Runciman moved:

That Bill S-209 be amended in clause 1, on page 1,

(a) by replacing line 14 with the following:

"of the International Olympic Committee or the International Paralympic Committee and,"; and

(b) by replacing line 18 with the following:

"contest is held with the permission of the lieutenant governor in council or other specified person or body.".

Debate arose thereon.

At 11:55 a.m., the committee suspended.

At 12:17 p.m., committee resumed.

After debate and with leave, the Honourable Senator Runciman moved:

That the motion in amendment be amended by deleting:

"and

(b) by replacing line 18 with the following:

"contest is held with the permission of the lieutenant governor in council or other specified person or body.""

Ms. Kane was called to the table and answered questions.

The question being put on the subamendment, it was adopted.

The question being put on the motion in amendment, it was adopted.

It was agreed that clause 1, as amended, carry.

It was agreed that the title carry.

It was agreed that the bill, as amended, carry.

It was agreed that the deputy chair report the bill, as amended, to the Senate.

At 12:20 p.m., the committee adjourned to the call of the chair.
