The Standing Senate Committee on Social Affairs, Science and Technology met this day, in Room 705, Victoria Building, at 10:00 a.m., the Chairman, the Honourable Lowell Murray, presiding.

Members of the committee present: The Honourable Senators Cohen, Cools, Kenny, Forest, Jessiman, Johnstone, LeBreton, Maheu, Murray, P.C. and Phillips (10).

In attendance: From the Research Branch of the Library of Parliament: Margaret Young, Research Officer.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on November 5, 1997, the committee resumed consideration of the implementation and application of Chapter 1, An Act to amend the Divorce Act, the Family Orders and Agreements Enforcement Assistance Act, the Garnishment, Attachment and Pension Diversion Act and the Canada Shipping Act, and the associated Federal Child Support Guidelines (for complete text of Order of Reference see Proceedings of the Committee, Issue No. 3, dated December 16, 1997).

WITNESSES:

Barry R. Gardiner, FCA, Chartered Accountant.

From the Equitable Child Maintenance and Access Society:

Michael A. LaBerge, President;

Marina Forbister, Past President.

The Chairman made a statement of introduction.

Mr. Gardiner made an opening statement and answered questions.

It was moved by the Honourable Senator Cools that the written submission addressed to the Committee and presented by Mr. Gardiner dated March 9, 1998 be printed as an appendix to this day's Minutes of Proceedings (see Appendix 5900/S2-SS-1, 6 "1").

The question being put on the motion, it was agreed.

It was moved that the brief of the Equitable Child Maintenance and Access Society entitled E.C.M.A.S. (Calgary Chapter) Brief presented to: The Senate of Canada, Social Affairs, Science and Technology, Analysis of the Implementation of Chapter 1 (Formerly Bill C-41) Presented by: Marina L. Forbister, C.A., Michael LaBerge, B.Sc., Tuesday, March 17, 1998, be printed as an appendix to this day's Minutes of Proceedings (see Appendix 5900/S2-SS-1, 6 "2").

The question being put on the motion, it was agreed.

Mr. LaBerge and Ms Forbister made opening statements and together answered questions.

A letter dated December 16, 1996 from the Honourable Allan Rock, P.C., M.P., Minister of Justice, addressed to Mrs. Carol P. Corbin, was filed as an exhibit with the clerk of the committee (Exhibit 5900 S2/SS-1 - 6 "4"). Case examples of child maintenance and custody issues were also filed as an exhibit with the clerk of the committee (Exhibit 5900/S2-SS-1 - 6 "5").

At 11:30 a.m., the committee adjourned to the call of the Chairman.

The Standing Senate Committee on Social Affairs, Science and Technology met this day, in Room 705, Victoria Building, at 3:30 p.m., the Chairman, the Honourable Lowell Murray, presiding.

Members of the committee present: The Honourable Senators Forest, Johnstone, LeBreton, Keon, Maheu and Murray, P.C. (6).

Other senator present: The Honourable Senator Chalifoux (1).

In attendance: From the Research Branch of the Library of Parliament: Mollie Dunsmuir, Research Officer.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on November 5, 1997, the Committee resumed consideration of Bill S-8, An Act to amend the Tobacco Act (content regulation) (for complete text of Order of Reference see Proceedings of the Committee, Issue No. 5, dated February 25, 1998).

WITNESSES:

From the Royal Canadian Mounted Police:

Superintendent R. G. (Rod) Smith, Officer in Charge, Customs and Excise Branch.

From the Department of Revenue Canada:

Mr. Mark Connolly, Director of Program Development, Contraband and Intelligence Services Directorate, Customs and Trade Administration Branch.

The Chairman welcomed the Honourable Senator Archibald Johnstone to the committee.

The Chairman made a statement of introduction.

Superintendent Smith made a statement and was joined by Mr. Connolly to answer questions.

It was agreed that the committee would meet in camera.

At 4:15 p.m., the committee adjourned to the call of the Chairman.

At 4:20 p.m., the committee reconvened in camera.

At 4:30 p.m., the committee adjourned to the call of the Chair.
