The Standing Senate Committee on Legal and Constitutional Affairs met this day at 9:03 a.m., in room 256-S, Centre Block, the chair, the Honourable Bob Runciman, presiding.

Members of the committee present: The Honourable Senators Baker, P.C., Batters, Beyak, Boisvenu, Dagenais, Fraser, Jaffer, Joyal, P.C., McIntyre, Ogilvie, Runciman, and White (12).

In attendance: Lyne Casavant and Dominique Valiquet, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Thursday, March 21, 2013, the committee continued its consideration of Bill C-55, An Act to amend the Criminal Code.

WITNESSES:

Justice Canada:

Carole Morency, Acting Director General and Senior General Counsel, Criminal Law Policy Section;

Karen Audcent, Senior Counsel, Criminal Law Policy Section.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-55, An Act to amend the Criminal Code.

It was agreed that the title stand postponed.

It was agreed that clause 1, which contains the alternative title be postponed.

The chair asked whether clause 2 shall carry.

The officials from Justice Canada were called to the table and answered questions from time to time.

After debate, it was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

The chair asked whether clause 5 shall carry.

After debate, it was agreed that clause 5 carry, on division.

The chair asked whether clause 6 shall carry.

After debate, it was agreed that clause 6 carry, on division.

The chair asked whether clause 7 shall carry.

At 9:45 a.m. the Honourable Senator Beyak replaced the Honourable Senator White as a member of the committee.

After debate, it was agreed that clause 7 carry, on division.

The chair asked whether clause 1, which contains the alternative title shall carry.

After debate, it was agreed that clause 1, which contains the alternative title carry, on division.

It was agreed that the title carry.

It was agreed that the bill carry, on division.

It was agreed that the chair report the bill to the Senate.

At 9:54 a.m., the committee adjourned to the call of the chair.
