The Standing Senate Committee on Legal and Constitutional Affairs met at 10:32 a.m. this day, in room 257, East Block, the chair, the Honourable Bob Runciman, presiding.
Members of the committee present: The Honourable Senators Baker, P.C., Batters, Dagenais, Doyle, Frum, Jaffer, Joyal, P.C., McIntyre, Plett, Rivest and Runciman (11).
In attendance: Robin MacKay and Julian Walker, analysts, Parliamentary Information and Research Service, Library of Parliament.
Also in attendance: The official reporters of the Senate.
Pursuant to the order of reference adopted by the Senate on Tuesday, April 1, 2014, the committee continued its study of Bill C-394, An Act to amend the Criminal Code and the National Defence Act (criminal organization recruitment). (For complete text of the order of reference, see proceedings of the committee, Issue No. 9.)

Matthew Taylor, Counsel, Criminal Law Policy Section.
The chair made an opening statement.
Mr. Taylor answered questions from time to time.
It was agreed that committee proceed with clause by clause consideration of Bill C-394, An Act to amend the Criminal Code and the National Defence Act (criminal organization recruitment).
It was agreed that the title stand postponed.
It was agreed that clause 1 carry.
It was agreed that clause 2 carry.
It was agreed that clause 3 carry.
It was agreed that clause 4 carry.
It was agreed that clause 5 carry.
The chair asked whether clause 6 shall carry.
The Honourable Senator Baker, P.C., moved:
That Bill C-394 be amended, on page 2, by adding after line 8 the following:
"6.1 Paragraph 196.1(5)(a) of the Act is replaced by the following:
(a) an offence under section 467.11, 467.111, 467.12 or 467.13;''
After debate, the question being put on the motion in amendment, it was negatived.
It was agreed that clause 6 carry, on division.
It was agreed that clause 7 carry.
It was agreed that clause 8 carry.
The chair asked whether clause 9 shall carry.
The Honourable Senator Baker, P.C., moved:
That Bill C-394 be amended in clause 9, on page 2, by replacing line 33 with the following:
"solicited, encouraged, coerced or invited is under 18''.
After debate, the question being put on the motion in amendment, it was negatived.
It was agreed that clause 9 carry, on division.
It was agreed that clause 10 carry.
It was agreed that clause 11 carry.
It was agreed that clause 12 carry.
It was agreed that clause 13 carry.
It was agreed that clause 14 carry.
It was agreed that clause 15 carry.
It was agreed that clause 16 carry.
It was agreed that clause 17 carry.
It was agreed that the title carry.
It was agreed that the bill carry.
The committee considered draft observations.
After debate, it was agreed that the draft observations be adopted and appended to the report.
It was agreed that the Subcommittee on Agenda and Procedure approve the final version of the observations.
It was agreed that the chair report the bill, with observations, to the Senate.
At 11:37 a.m., the committee suspended.
At 11:47 a.m., the committee resumed.
Pursuant to the order of reference adopted by the Senate on Wednesday, May 28, 2014, the committee began its study of the document entitled Proposals to correct certain anomalies, inconsistencies and errors and to deal with other matters of a non-controversial and uncomplicated nature in the Statutes of Canada and to repeal certain provisions that have expired, lapsed or otherwise ceased to have effect.
