The Standing Senate Committee on National Security and Defence met this day at 9:30 a.m., in room 356-S, Centre Block, the chair, the Honourable Daniel Lang, presiding.
Members of the committee present: The Honourable Senators Beyak, Boisvenu, Boniface, Dagenais, Harder, P.C., Hartling, Jaffer, Kenny, Lang, Lankin, P.C., Moncion, Saint-Germain, Smith and White (14).
In attendance: Mark Palmer, Committees Directorate.
Also present: The official reporters of the Senate.
Pursuant to the order of reference adopted by the Senate on Tuesday, May 30, 2017, the committee continued its examination of Bill C-22, An Act to establish the National Security and Intelligence Committee of Parliamentarians and to make consequential amendments to certain Acts. (For complete text of the order of reference, see proceedings of the committee, Issue No. 15.)
The chair made a statement.
It was agreed that the committee proceed to clause-by-clause consideration of Bill C-22, An Act to establish the National Security and Intelligence Committee of Parliamentarians and to make consequential amendments to certain Acts.
It was agreed that the title stand postponed.
It was agreed that clause 1, which contains the short title, stand postponed.
It was agreed that clause 2 carry.
It was agreed that clause 3 carry.
The chair asked whether clause 4 shall carry.
The Honourable Senator Kenny moved that Bill C-22 be amended in clause 4, on page 2, by replacing lines 33 and 34 with the following:
"of Parliamentarians is established, consisting of a Co-Chair who is a member of the Senate and a Co-Chair who is a member of the House of Commons and up to 9 other members, each of whom must be a''.
After debate, the question being put on the motion in amendment, it was negatived by a show of hands.
The Honourable Senator Kenny moved that Bill C-22 be amended in clause 4, on page 3,
(a) in line 3, by replacing the word "three'' with "five''; and
(b) in line 5, by replacing the word "eight'' with "six''.
After debate, the question being put on the motion in amendment, it was negatived by a show of hands.
After debate, it was agreed that clause 4 stand.
The chair asked whether clause 5 shall carry.
The Honourable Senator Kenny moved that Bill C-22 be amended in clause 5, on page 3,
(a) by replacing lines 11 to 13 with the following:
"5 (1) Subject to subsection (1.01), the members of the Committee are to be appointed by the Governor in Council.
(1.01) The Prime Minister is to submit to the Senate the names of the members of the Senate to be appointed to the Committee, and to the House of Commons the names of the members of that House to be appointed to the Committee, and if each House approves of the members of their respective Houses to be appointed, the Governor in Council shall appoint those members.
(1.02) The members of the Committee are to hold office during pleasure until''; and
(b) by deleting lines 19 to 29.
After debate, the question being put on the motion in amendment, it was negatived by a show of hands.
It was agreed that clause 5 carry.
The chair asked whether clause 6 shall carry.
The Honourable Senator Kenny moved that Bill C-22 be amended in clause 6, on page 4,
(a) by replacing lines 3 to 5 with the following:
"6 (1) The Chair shall be elected by majority vote by means of a secret ballot of the members of the Committee.''; and
(b) by replacing lines 8 to 10 with the following:
"other members to act as Chair for a maximum of 90 days.''.
After debate, the question being put on the motion in amendment, it was negatived by a show of hands.
It was agreed that clause 6 carry.
It was agreed that clause 7 carry.
The chair asked whether clause 8 shall carry.
The Honourable Senator Kenny moved that Bill C-22 be amended in clause 8, on page 4,
(a) by replacing lines 22 to 24 with the following:
"tivity is an ongoing operation and the appropriate Minister informs the Committee that the activity is an ongoing
operation; and''; and
(b) by replacing lines 28 to 34 with the following:
"(2) If the appropriate Minister is informed that the activity is''.

(a) by replacing line 26 with the following:

(1.1) The Prime Minister is to submit to the Committee, in confidence, the name of a person to be appointed to the office of executive director and if a majority of the members of the Committee who are members of the Senate, and a majority of the members of the Committee who are members of the House of Commons, approve, the Governor in Council is to appoint that person.
(1.2) The executive director is''; and
(b) by replacing line 28 with the following:
"years but may be removed by the Governor in Council on address of the Senate and the House of Commons. The
executive director is eligible to be reappointed''.
