The Special Senate Committee on Anti-terrorism met this day at 1:30 p.m., in room 9, Victoria Building, the chair, the Honourable Senator Hugh Segal, presiding.

Members of the committee present: The Honourable Senators Buth, Dagenais, Dallaire, Day, Frum, Joyal, P.C., Segal, Smith, P.C. (Cobourg) and Tkachuk (9).

In attendance: Lyne Casavant and Holly Porteous, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Thursday, May 17, 2012, the committee continued its examination of Bill S-9, An Act to amend the Criminal Code. (For complete text of the order of reference, see proceedings of the committee, Issue No. 4.)

WITNESSES:

Royal Canadian Mounted Police:

Gilles Michaud, Assistant Commissioner, National Security Criminal Investigations.

Foreign Affairs and International Trade Canada

Sabine Nolke, Director General, Non-Proliferation and Security Threat Reduction.

At 2:30 p.m., the committee suspended.

At 2:35 p.m., the committee resumed.

Mr. Michaud made a statement and answered questions.

Ms. Nolke made a statement and answered questions.

At 2:40 p.m., the committee proceeded to clause-by-clause consideration of Bill S-9, An Act to amend the Criminal Code.

WITNESS:

Department of Justice Canada:

Greg Koster, Counsel, Criminal Law Policy Section.

Mr. Koster answered questions.

It was agreed that the title stand postponed.

It was agreed that clause 1, which contains the short title, stand postponed.

It was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

The chair asked whether clause 5 shall carry.

The Honourable Senator Dallaire moved:

That Bill S-9 be amended in clause 5, page 4:

Replace line 7 with the following:

 "damage to property or the environment, makes a device or pos- ";

After debate, the question being put on the motion in amendment, it was adopted.

The Honourable Senator Frum moved:

That Bill S-9 be amended in clause 5, page 4:

(a) Replace line 10 with the following:

 "al or a device or commits an act against a "; and

(b) Replace line 19 with the following:

 "device or commits an act against a nuclear ".

After debate, the question being put on the motion in amendment, it was adopted.

It was agreed that clause 5, as amended, carry.

It was agreed that clause 6 carry.

It was agreed that clause 7 carry.

It was agreed that clause 8 carry.

It was agreed that clause 9 carry.

It was agreed that clause 10 carry.

It was agreed that clause 1, which contains the short title, carry.

It was agreed that the title carry.

It was agreed that the bill, as amended, carry.

The committee considered draft observations as prepared for the committee by the analysts.

It was agreed that the committee append these observations to the report.

Senator Dallaire moved that his additional observations, as circulated to the committee, be appended to the report.

After debate, the question being put on the motion, it was negatived by a show of hands.

It was agreed that the Subcommittee on Agenda and Procedure be empowered to approve the final version of the observations being appended to the report, taking into consideration the committee's discussion and any necessary editorial, grammatical or translation changes as required.

It was agreed that the chair report the bill, as amended and with observations, to the Senate.

At 3:20 p.m., the committee adjourned to the call of the chair.
