The Standing Senate Committee on Transport and Communications met this day at 6:45 p.m., in room 2, Victoria Building, the chair, the Honourable Dennis Dawson, presiding.
Members of the committee present: The Honourable Senators Boisvenu, Cochrane, Dawson, Eaton, Greene, MacDonald, Martin, Merchant, Munson, Verner, P.C., and Zimmer (11).
In attendance: Dean Ruffilli, Analyst, Parliamentary Information and Research Service, Library of Parliament.
Also in attendance: The official reporters of the Senate.
Pursuant to the order of reference adopted by the Senate on Wednesday, November 2, 2011, the committee continued its consideration on Bill S-4, An Act to amend the Railway Safety Act and to make consequential amendments to the Canada Transportation Act.

Mr. Benson, Mr. Smith, Mr Brehl, Mr. Shouldice and Mr. Jeanes each made opening statements and, together, answered questions.
At 7:08 p.m., the committee suspended.
At 7:10 p.m., the committee resumed.
It was agreed that the committee proceed to clause-by-clause consideration of Bill S-4, An Act to amend the Railway Safety Act and to make consequential amendments to the Canada Transportation Act.
With leave, it was agreed that the committee be allowed to group several clauses together for the purpose of clause- by-clause consideration of Bill S-4.
It was agreed that the title stand postponed.
It was agreed that clause 1, which contains the short title, stand postponed.
It was agreed that clauses 1 to 10 carry.
It was agreed that clauses 11 to 20 carry.
It was agreed that clauses 21 to 30 carry.
It was agreed that clauses 31 to 36 carry.
The chair asked whether clause 37 shall carry.
The Honourable Senator Eaton moved that Bill S-4 be amended in clause 37, on page 36, by replacing lines 24 and 25 with the following:
"reporting and confidential reporting to Transport"
After debate, the question being put on the motion in amendment, it was adopted.
It was agreed that clause 37, as amended, carry.
It was agreed that clauses 38 to 45 carry.
It was agreed that clause 1, which contains the short title, carry.
It was agreed that the title carry.
It was agreed that the bill, as amended, carry.
It was agreed that the chair report the bill, as amended, to the Senate at the earliest opportunity.
At 7:16 p.m., the committee adjourned to the call of the chair.
