The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10:32 a.m., in room 257, East Block, the chair, the Honourable Serge Joyal, P.C., presiding.

Members of the committee present: The Honourable Senators Batters, Boisvenu, Carignan, P.C., Dalphond, Dawson, Dupuis, Frum, Gold, Joyal, P.C., Lankin, P.C., McIntyre and Pratte (12).

Other senator present: The Honourable Senator Pate (1).

In attendance: Julian Walker, Maxime Charron-Tousignant and Laurence Brosseau, Analysts, Parliamentary Information and Research Services, Library of Parliament; Ben Silverman, Communications Officer, Senate Communications Directorate.

Also present: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Wednesday, November 7, 2018, the committee began its examination of the subject matter of those elements contained in Division 20 of Part 4 of Bill C-86, A second Act to implement certain provisions of the budget tabled in Parliament on February 27, 2018 and other measures.

WITNESSES:

Department of Justice Canada:

Mark Scrivens, Senior Counsel, Policy Sector, Policy Implementation Directorate.

Public Prosecution Service of Canada:

Jeff Richstone, Senior General Counsel and Director General, Regulatory and Economic Prosecutions.

The chair made a statement.

Mr. Scrivens made a statement and, together with Mr. Richstone, answered questions.

The committee discussed a draft report.

It was agreed that the chair, in consultation with the deputy chairs, be empowered to approve the final wording of the report taking into consideration the committee's discussion relating to Division 20 of Part 4 of Bill C-86, A second Act to implement certain provisions of the budget tabled in Parliament on February 27, 2018 and other measures.

At 11:37 a.m., the committee suspended.

At 11:45 a.m., the committee resumed.

At 11:45 a.m., pursuant to the order of reference adopted by the Senate on Wednesday, November 7, 2018, the committee continued its examination of Bill C-76, An Act to amend the Canada Elections Act and other Acts and to make certain consequential amendments. Mr. Côté made a statement and, together with Mr. Chénier, answered questions.

At 1:29 p.m., the committee adjourned to the call of the chair.
