The Standing Senate Committee on National Security and Defence met this day at 11:16 a.m., in room 2, Victoria Building, the chair, the Honourable Daniel Lang, presiding.
Members of the committee present: The Honourable Senators Beyak, Carignan, P.C., Dagenais, Day, Jaffer, Lang, Meredith and White (8).
Other senator present: The Honourable Senator Moore (1).
In attendance: Dominique Valiquet and Katherine Simonds, Analysts, Parliamentary Information and Research Services, Library of Parliament.
Also present: The official reporters of the Senate.
Pursuant to the order of reference adopted by the Senate on April 14, 2016, the committee continued its examination of Bill S-205, An Act to amend the Canada Border Services Agency Act (Inspector General of the Canada Border Services Agency) and to make consequential amendments to other Acts. (For complete text of the order of reference, see proceedings of the committee, Issue No. 4).
The chair made a statement.
At 11:19 a.m., the committee suspended.
At 11:20 a.m., the committee, pursuant to rule 12-16(1)(d), resumed in camera for the consideration of a draft agenda (future business).
At 11:38 a.m., the committee suspended.
At 11:38 a.m., the committee resumed in public.
It was agreed that the committee proceed to clause-by-clause consideration of Bill S-205, An Act to amend the Canada Border Services Agency Act (Inspector General of the Canada Border Services Agency) and to make consequential amendments to other Acts.
It was agreed that the title stand postponed.
It was agreed that clause 1 carry.
The chair asked whether clause 2 shall carry.
The Honourable Senator Carignan, P.C., moved:
That Bill S-205 be amended in clause 2,
(a) on page 3, by replacing lines 22 to 44 with the following:
"15.5 The mandate of the Inspector General is to consider any complaint made under subsection 15.6(1)."; and
(b) on page 4, by deleting lines 1 to 10.
After debate, the question being put on the motion in amendment, it was adopted.
The chair asked whether clause 2 shall carry.
The Honourable Senator Carignan, P.C., moved:
That Bill S-205 be amended in clause 2, on page 4, by replacing lines 11 to 13 with the following:
"15.6 (1) Any person who claims to be aggrieved by any act or thing done by the Agency may make a complaint to the Inspector General and, subject to this".
The question being put on the motion in amendment, it was adopted.

The Honourable Senator Jaffer moved:
That Bill S-205 be amended in clause 2, on page 9, by adding the following after line 39:
"15.191 The Inspector General's decisions in respect of a complaint or an investigation under this Act, and the findings and recommendations contained in the Inspector General's report referred to in subsection 15.11(1), are final and are not subject to appeal or to review by any court.";
(b) on page 10, by deleting lines 5 to 42; and
(c) on page 11, by deleting lines 1 to 43.
The question being put on the motion in amendment, it was adopted.

The Honourable Senator Jaffer moved:
That Bill S-205 be amended in clause 2, on page 10, by replacing line 4 with the following:
"$5,000.".

That the Law Clerk and Parliamentary Counsel be authorized to make any necessary changes to the numbering of the proposed sections contained in clause 2 and to all cross-references thereto.
