Pursuant to the order of the Senate of November 25, 2021, the Standing Senate Committee on Legal and Constitutional Affairs met this day in room C128, Senate of Canada Building, and with videoconference at 4:15 p.m. ET, the chair, the Honourable Mobina S. B. Jaffer, presiding.

Members of the committee present: The Honourable Senators Batters, Boisvenu, Clement, Cotter, Dalphond, Harder, P.C., Pate and Tannas (8).

Members of the committee present by videoconference: The Honourable Senators Boniface, Campbell, Dupuis, Gold, P.C. and Jaffer (5).

Other senators present: The Honourable Senator Quinn (1).

Pursuant to the order of reference adopted by the Senate on Tuesday, March 1, 2022, the committee continued its consideration of the motion regarding the taxation of the Canadian Pacific Railway in Saskatchewan.

James Clements, Senior Vice-President, Strategic Planning and Technology Transportation.

As an individual:

Benoît Pelletier, Professor, University of Ottawa;

Dwight Newman, Professor of Law and Canada Research Chair in Indigenous Rights in Constitutional and International Law, University of Saskatchewan.

Laval University:

Patrick Taillon, Professor and co-director, Centre for Constitutional and Administrative Law Studies, Laval University.

James Clements made a statement and answered questions.

At 5:17 p.m., the committee suspended.

At 5:19 p.m., the committee resumed.

Benoît Pelletier, Dwight Newman and Patrick Taillon each made a statement and answered questions.

At 6:26 p.m., the committee adjourned to the call of the chair.
