The Standing Senate Committee on Legal and Constitutional Affairs met this day at 11:35 a.m., in room B30, Senate of Canada Building, the chair, the Honourable Brent Cotter, presiding.

Members of the committee present: The Honourable Senators Arnot, Aucoin, Batters, Carignan, P.C., Clement, Cotter, Dalphond, Oudar, Pate, Prosper and Simons (11).

Other senators present: The Honourable Senator Senior (1).

Participating in the meeting: Emilie Doyon, Analyst, Library of Parliament.

Pursuant to the order of reference adopted by the Senate on Thursday, October 10, 2024, the committee continued its consideration of Bill C-40, An Act to amend the Criminal Code, to make consequential amendments to other Acts and to repeal a regulation (miscarriage of justice reviews).

Criminal Lawyers’ Association:

Jessica Zita, Member.

Barreau du Québec:

Catherine Claveau, President of the Quebec Bar (by videoconference);

Nicolas Le Grand Alary, Lawyer, Secretariat of the Order and Legal Affairs (by videoconference).

Canadian Criminal Justice Association:

Myles Frederick McLellan, Chair, Policy Review Committee.

Canadian Association of Black Lawyers:

K. Paul Erskine, Member, Criminal Justice and Police Reform Subcommittee (by videoconference).

Canadian Council of Criminal Defence Lawyers:

Mark Knox, Board member for Nova Scotia (by videoconference).

Tony Paisana, Jessica Zita and Catherine Claveau each made a statement and, together with Nicolas Le Grand Alary, answered questions.

At 12:43 p.m., the committee suspended.

At 12:47 p.m., the committee resumed.

Myles Frederick McLellan, K. Paul Erskine and Mark Knox each made a statement and answered questions.

At 1:39 p.m., the committee adjourned to the call of the chair.
