The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Salon A, Hotel Newfoundland, St. John's, Newfoundland, at 9:00 a.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the committee present: The Honourable Senators Anderson, Beaudoin, Carstairs, Cogger, Doody, Jessiman, Kinsella, Lewis, Pearson, and Rompkey (10).

Other senators present: The Honourable Senator Finlay MacDonald (Halifax) and the Honourable Senator Gerald Ottenheimer. (2).

In attendance: Mollie Dunsmuir, Research Officer, Research Branch of the Library of Parliament; Laura Snowball, Research Officer, Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

APPEARING:

The Honourable Roger Grimes, Minister of Education, Government of Newfoundland and Labrador.

WITNESSES:

Mr. Loyola Sullivan, M.H.A., Leader of the Official Opposition of Newfoundland and Labrador.

Mr. Jack Harris, Leader of the New Democratic Party of Newfoundland and Labrador.

Department of Education, Province of Newfoundland and Labrador:

Ms Deborah Fry, Assistant Deputy Minister;

Ms Gail Welsh, Legal Counsel.

Pursuant to the Order of Reference adopted by the Senate on Thursday, June 13, 1996, the Committee continued its consideration of the resolution to amend the Constitution of Canada, Term 17 of the Terms of Union of Newfoundland with Canada. (For full text of Order of Reference please refer to Issue 19, Tuesday, June 18, 1996.)

The Chair made a statement.

Mr. Loyola Sullivan made a statement and answered questions.

Mr. Jack Harris made a statement and answered questions.

The Honourable Roger Grimes made a statement.

Minister Grimes tabled with the Committee a statement from Brian Tobin, Premier of Newfoundland and Labrador dated July 9, 1996, (Exhibit 5900 L1/SS1-25 "1"), a press release from Mr. Gerald Fallon of the Catholic Education Council (Exhibit 5900 L1/SS1-25 "2") and some related text from the Liberal Party Red Book (Exhibit 5900 L1/SS1-25 "3").

Minister Grimes, with Ms Deborah Fry and Ms Gail Welsh, answered questions.

The Chair thanked the staff from the Hotel Newfoundland for their invaluable help and the people of Newfoundland for their interest and participation to the Committee's work.

At 12:29 p.m., the committee adjourned to the call of the Chair.
