The Standing Senate Committee on Legal and Constitutional Affairs, met this day, in camera, in Room 505, Victoria Building, at 4:05 p.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the committee present: The Honourable Senators Beaudoin, Carstairs, Doyle, Jessiman, Lewis, Losier-Cool, Milne, Moore, Nolin, and Pearson (10).

In attendance: Marilyn Pilon, Research Officer, Research Branch of the Library of Parliament.

Also in attendance: The official reporters of the Senate.

WITNESSES:

From the Canadian Association of Chiefs of Police:

Chief Julian Fantino (London, Ontario), Member, Law Amendments Committee.

From The Canadian Police Association:

Mr. Grant Obst, Vice-President;

Mr. Scott Newark, Executive Officer.

Pursuant to the Order of Reference adopted by the Senate on Thursday, May 2, 1996, the committee continued its consideration in camera of Bill S-3, An Act to amend the Criminal Code (plea bargaining). (See Issue No. 28, September 26, 1996, for full text of Order of Reference).

The committee considered a draft report.

After debate,

It was agreed -- THAT the Committee report to the Senate recommending that Bill S-3 not be proceeded with further.

At 4:10 p.m., the committee continued in public.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 22, 1996, the committee continued its consideration of Bill C-45, An Act to amend the Criminal Code (judicial review of parole ineligibility) and another Act. ( See Issue No. 32, Wednesday, October 30, 1996, for full text of Order of Reference.)

Chief Julian Fantino made a statement.

Mr. Grant Obst and Mr. Scott Newark made a statement.

The witnesses answered questions.

Chief Fantino left with the committee a copy of the Canadian Association of Chiefs of Police's resolution regarding the repeal of section 745 of the Criminal Code. (Exhibit No. 5900 L1-C-45-34 "2")

At 5:15 p.m., the committee adjourned to the call of the Chair.
